I am presenting this letter to you in the form of an affidavit,
so that in the event that you choose not to correct the Lock-in,Lock-out
Protocol, that you have implemented at I¢C, and the violence and blood~
shed continues, you will not be able to say that you were not well infor-
med, and that you might be held criminally responsible, and then you will
have the good fortune to live at ICC. I am sendina you’a concern form with
several pages, so that I will have the apriew ToGRrEVF 40 appeal said
concern forms’and present them in Federal Court,
The Concern Forms state the following:

Mr. Renike, on or about 06/07/10, 1cc started the lock-in, lock-out
Protocol once again "Due to an increase in the number of incidents
ef violence at ICC" Per your request. (Sce:Letter). This protocol is
an act of retaliation and group punishment against the inmate popul~
ation, The problem is not with the inmates (there is always going to
be some fights) it is with A, the placement of inmates by ICC staff,
cc staff knowingly place inmates in very high risk areas, that ICC
staff knows that an inmate is very likely to be assaulted. Ice staff
does this by either lack of training or deliberate indifferent,
I feel that it is the latter, T myself sent concern forms to 1cC,
staff as early as 2007, and inquired as to why the staff «continues to

a letter to John. Ferguson (CEO of CCA) begging for him to help, but
he mever helped and the violence has gotten very bad. and B, By IDOC
failure to enforce IcC/cca, to keep adequately trained staff and or
enough staff to handle the’number of prisoners at the TbOC/Tce/cca
PRISON FOR PROFIT. As you know CCA made a profit of $155,000,000,
jast year, See: RIGGS v. VALDEZ-CCA, With profits like this, you’ and
roc, at the very least should make sure that ICC has adequately

to warehouse as many as prisoners that TpOC has, So that CCA can keep
its shareholders happy. As you know the problem of inmate on inmate
assaults here at ICC is very high compared to other ID0C facilities,
The other DOC facilities are not trying to produce a profit, which
would stand to reason that just tiaybe ICc/ccA, is trying to keep the
violence and bloodshed as high as they can, so that they can give out
D.O.R.s and keep as many prisoners from going out on parole as poss~
ible, to keep CCA profits up. C. Your enforcement of the lock-in
lock-out protocol has now placed inmates in a position of authority
over each other. Inmates are required to shut there own doors after
leaving or they will face disciplinary action, and if they don't then
there cell~mate will get disciplinary action if he is there when
staff comes by the cell. There has already been threats of violence
from one cell-mate to the other, because one inmate said make the cops
shut the fucking doors its there job, the other inmate said I don't
want to face disciplinary action, because he had a shot at parole
soon, the inmate who want the staff to shut the doors said fuck you
I have a life-sentence and I don't care and I'll beat your ass if
you shut the door. So my question is "When and how are you going to
stop the retaliation and_qroup punishment against, the inmates”.
This retaliation and group punishment is because of your own failures
and the failures of 1D0c as a whole, because you don't want to hold
CC accountable. If you were not aware of this violence and blood-
shed that has been going on at ICC, for several years then I apolog-
ies, but if you were aware of it (and I think you were) then T would
recommend, that you inform our good Governor Butch "otter" and ask
him to replace you with a competent Director before someone gets
killed, I feel that as Director of the Prison you have either condoned
or have become blind to the bloodshed and violence that is right in
front of your eye's,

Subject; Increase in Incidents at the Idabo Correctional Center
Dear Mr. Conry:
We are seeing an increase in the number of incidents and violence at the Idaho
Correctional Center (ICC). During the month of April, six (6) incidents were reported
Since the beginning of May, there have been 11 reported incidents. Of the 11 incidents,
‘two (2) involved weapons and one (1) incident required off-site emergency medical care.
When Warden Wengler took control of ICC in March, he implemented the lock-in, lock-
cout protocol in the facility to control inmates’ movement in and out of cells, We feel that
lock-in, lock-out is a good, sound management tool that protects both staff and inmates.
In the April | monthly meeting, Warden Wengler stated that he planned to ease Jock-in,
lock-out as housing units calmed down, He also indicated that lock-in, lock-out would be
activated if incidents increased in housing units. As of today, the protocol has not been
activated even though incidents are increasing. With the increase in incidents it is time to
activate lock-in, lock-out. Our expectation is that the protocol will be implemented
immediately and that the procedure will be a permanent, on-going part of operations at
Icc,
Please let us know as soon as lock-in, lock-out is activated at ICC.
