Dear Ms. DePape,
Following your communication with Rights & Democracy on March 29, 2010 and on April 21,
2010, please find attached the documents requested by the Standing Committee on Foreign
‘Affairs and International Development regarding its study of the situation at Rights &
Democracy. Included are
¥ Contract between Rights & Democracy and Samson Beair/Deloite & Touche
Contract between Rights & Democracy and Prima Communications
Contract between Rights & Democracy and Borden Ladner Gervais
However, I don’t have any contrat for Ogilvy Renault and Woods LLP.
1. Any reports that have been produced by the above-listed firms.
With regard to the retainer with SIRCO, I can confirm that, on February 15, 2010, Rights and
Democracy retained the fm SIRCO to conduct an investigation. The SIRCO investigation has
‘ot been completed. The report will form the basis of our defence in litigation instituted against
Rights and Democracy by its former employees and in other ciumstances, would be privileged
and confidential. Therefore, it would be highly prejudicial to Rights and Democracy, and
compromise its postion before the courts, if the retainer leter was disclosed prior to the
‘completion of the investigation and prior tothe conclusion ofthe litigation. Premature disclosure
of the retainer letter would significantly undermine the purpose ofthe investigation and is value
‘would be lost. Rights and Democracy wishes to co-operate full with the Committe and would
prefer to provide the Committe wit a copy of the retainer agreement once the litigation bas been
‘completed or, befor, if t becomes public in the course ofthe litigation
‘The forensic audit report from Samson BelarDeloite & Touche will be finalized sometime in
‘the month of June at which point it wil be provided tothe Committe.
