What is an NGO?
Definition: not part of government and not conventional for profit
Types: Charity, Participatory, Empowering, Service, SE, SRB, Start Ups, CBOS
Registration: Trust, Society, Non-profit Company (Sec 8-2013, Sec 25-1956)
Scale: Local, National, International
GRO: Government Related Organisations (Citizens Alliance, NUSSD)
[Method of Collaboration]
Lack in Apex body and policy: therefore lack in standardised roles and
monetary compensation, lack in accountability [1 NGO for every 400
citizens in India]
Difference between Project (temporary, time bound, specific objectives) &
Program (Umbrella, portfolio with multiple projects)

Laws & Regulations


Registrar of Societies and Registrar of Companies
SECTION 8 Company: mandate profits to be used to fulfil objectives
MoA or AoA: Managing Committee, Board, min. 2 Board members, no upper limit
INC-1 Form, five names for refutation, CA/Advocate, Notary (?), Company Secretary (?)
Declaration, Statement of Liabilities and Assets, Estimate I&E

SOCIETIES:
Societies Registration Act, 1860 (Each state has its own), min 7 Trustees
No stamp paper, Memorandum of Association (MoA) or Articles of Association (AoA)
MoA: charter of a society, describing objectives and its operations.
AoA: includes rules and regulations of the society under which it works.

TRUSTS:
typical with physical land holding, infrastructure support, different Acts for different
States, Trusts Act 1882
Trust Deed: Mode and Management of Organisation, Roles and Responsibilities of
Trustees (no.?), signed with witnesses on non-judicial stamp paper (?) (depending
on value of property)

SPECIAL LICENSING
Restricted Areas: Inner Line Permit (?)
Shop and Establishment Act (If an office and employing people)
FCRA & NOC (foreign staff)
