EXPLANATORY NOTE
Upon the initiative of the then Honorable Antonio M. Serapio, representing the
then lone district of the Municipality of Valenzuela, through House Bill No. 1921, the
Municipality of Valenzuela was converted into a highly urbanized city upon the enactment
of Republic Act 8526 on 14 February 1998. Hence, the birth of “Valenzuela City.”
However, R.A. 8526 inadvertently missed the provision on the “City Prosecutor's
Office,” which is inherent in every newly converted municipality into a highly urbanized
city. Absence such a provision would imperil the effective administration of justice within
the city. Hence, this bill entails to rectify such inadvertence by adding the same in the city
charter.
It is in this light that the immediate consideration of this bill is earnestly sought.

AN ACT AMENDING REPUBLIC ACT NO. 8526, OTHERWISE KNOWN AS.
THE “CHARTER OF THE CITY OF VALENZUELA,” INCORPORATING
THEREIN THE PROVISION ON THE PkOSECUTOR’S OFFICE
Be i enacted by the Senate and House of Representatives of the Philippines in Congress
assembled:
SECTION. 1. There shall be added Article VIII of R.A. 8526, otherwise known.
as the “Charter of the City of Valenzuela” and the Act is hereby amended to read as
follows:
“ARTICLE VII
‘THE CITY PROSECUTOR'S OFFICE
SEC. 45. The City Prosecution Service. — (a) there shall be established in the City
fa prosecution service to be headed by a city prosecutor and such number of assistant
prosecutors as may be necessary, who shall be organizationally part of the Department of
Justice, and under the supervision and control of the Secretary of Justice and whose
qualifications, manner of appointment, rank, salary and benefits shall be governed by
existing laws covering prosecutors in the Department of Justice.
(b) The city prosecutor shall handle the criminal prosecution in the municipal trial
in the City as well as in the regional trial courts for criminal cases originating in the
territory of the City, and shall render to or for the City such services as are required by
law, ordinance or regulation of the Department of Justice.
SEC. 2. Section 45 of the Act shall be numbered 46 and all subsequent titles and
the corresponding sections shall be numbered accordingly
SEC. 3. All laws, orders, decrees, and other issuances or parts thereof which are
inconsistent with this Act are hereby repealed or modified accordingly.
SEC. 4, This Act shall take effect fifteen (15) days following its publication in at
least two (2) newspaper of general circulation
