RESUMO

O presente artigo resultado da concentrao de esforos que perseguem uma das

antigas questes que a humanidade ainda hoje investiga, a definio e
compreenso de justia, sua influncia e relevncia para o Direito, sem, contudo,
objetivar respond-las cabalmente. Apenas fazer alguns apontamentos sem ambio
de permanncia. Faz-se uma (re)leitura desde a gnese de justia platnica,
caracterizada pela variabilidade de seu conceito, passando pela perspectiva
utilitarista/asceticista de Jeremy Bentham, e igualmente pelo mote aristotlico de
equidade. A anlise das principais concepes de justia ser abordada neste
ensaio, especialmente quanto sua acepo subjetiva e objetiva, formal e material,
reunindo as reflexes apresentadas para a aplicao em problemas prticos
propostos. Permitindo a concluso de uma inexequibilidade absoluta de definio
peremptria de justia, vlida para todas as circunstncias demarcadas no mesmo
tempo e espao. De tal modo, que as acepes apresentadas so vlidas, porm,
so apenas pretenses.

Abstract
The present article is the result of the concentration of efforts that pursue one of the
old issues that humanity still investigates, the definition and comprehension of
justice, its influence and relevance to the law, without, however, aim to answer them
fully. Only to make some notes without the ambition to permanence. It makes a
(re)reading since the genesis of Platonic justice, characterized by the variability of its
concept, through the utilitarian perspective/asceticism of Jeremy Bentham, and also
by the Aristotelian theme of equity. The analysis of the main conceptions of justice
will be addressed in this essay, especially as to its subjective and objective, formal
and material meaning, bringing together the ideas presented for use in proposed
practical problems. Allowing the completion of an absolute unenforceability of
peremptory definition of justice, valid for all circumstances marked at the same time
and space. Such that the meanings given are valid, however, they are just claims.
