complaint. Det John Vergona told me he does not work for me but for the police dept. This was clearly pay back for

defending NYPD IA crimes my case. This is
a legal filling with many reasons why you should not dismiss my case. I went to get medical
care and now spent years and a lot of money pursing Justice enduring terrible grief my Dad
dying knowing KELLYs role and my Mom dying so please read. Before I continue to explain
why you should not throw out my case making I fear the 3rd court system to allow the NYPD
and Internal Affairs get away with violating my Constitutional Rights by coercing me, repeatedly
turning me away, refusing evidence and falsifying police reports I must stop right here and have
you and anyone looking at this case look at 7 pages of EXHIBITS aka EVIDENCE that you
must see now and subtract from the page numbers of this opposition to dismiss. The evidence
includes KELLY, CAMPISI head of internal affairs on record defending a series of crimes by the
NYPD IA in a letter to Judge Nathan Exhibit 5 page 8 + evidence VERGONA and HOOKS lied
with Lt. BURGOS, Sgt CHENs protection, than CO Ed WINSKI, and all defendants as well as
of series of John Does and Jane Does I dont know their names from Internal Affairs and top
brass 1 Police Plaza. VERGONA yelled at me you are going to drop those charges or I am going
to arrest you! He threatened me repeatedly moving the date to Saturday if I did not drop charges.
He was false arresting me for Delita HOOKS savage attack which I was suppose to accept the
violence, VERGONA falsifying a savage attack series of crimes into mutual assault keep my
head down stay out of trouble VERGONAs words! Why? I am a whistle blower aka trouble
maker. Look at the evidence and the opposition to dismiss which resumes after the letter to
Judge Nathan by the defendants who now are fleeing responsibility because they fear being
deposed now more than ever w/ a Federal Probe investigating top brass taking gifts doing fixing
and favor and being exposed for what they did to me and I am sure I am not the only victim.

It appears Corp Counsel is confident it is a slam dunk you will dismiss my case. If you
dismiss my case than my pro se lawsuit joins Eric Garners handwritten pro se lawsuit
Exhibit 161-f in the history books. Corp counsel will be questioned hopefully under oath in

front of a new commission about their role in my case since in Appellate court in the oral
arguments which I posted on YouTube the corp counsel defense attorney Jonathan Popolow
states in front of 3 judges Ms. Troy has reason to feel aggrievedbut he said my
constitutional rights were not violated and in fact there were. The NYPD worse than
violated my Constitutional rights and their oaths to uphold the Constitution, the NYPD
with Internal Affairs protection & Ray KELLY and Charles CAMPISIs protection broke
the law, lied in police reports, I was threatened with false arrest on the Sabbath if I did not
drop the charges and the threats were verbally violent and frightening! So Popolow from
Corp Counsel admitted some form of guilt on behalf of his clients yet corp counsel has yet
to offer me a settlement. Why? Because I am pro se 3 courts now please look at the
evidence because I have no law degree and it is crucial to my case & Justice.
I am the loudest, most tenacious voice, the only voice to demand every day from my blog
and YouTube Channel Suzannahartist a prosecution of 911 tech crooks, consultants that
over billed and the lobbyists that profited and Cy Vance let these crooks off the hook to
save Bloombergs tarnished legacy +Haggerty Trial+ CityTime + selling lies crime was
down when for example crimes like I was the victim of were erased and 911 top NYPD
brass promoted after caught doing fixing and favors like Chief Chuck Dowd who took
lavish gifts from at least 1 tech contractor 911 as reported by the NYDN and my guess HP
too. Hewlett Packard HP the lead contractor openly over billing aka stealing, delivered
late and delivered crap. Cy Vance let the NYPD IA my case off so there is a pattern like
the NYPD IA, ECTP aka 911 along with the contractors. The cover page of my motion to
not dismiss in Federal court under Judge Nathan says HP and here I am in NY State Supreme
Court now thankfully the news is now out there is a Federal probe focused on top brass NYPD

brass taking gifts. Team Cy my case was meeting with 2 john does whos names I was not
allowed to know and plans were halted to have Special Investigator Siobhan Berry arrest Delita
HOOKS. I was told the DA would not have the NYPD arrest Delita HOOKS but no surprise
Team Cy was going to protect the NYPD threatening me, coercing me, lying in police reports
which I turned in to the DA and I told the DA my belief Tacopina guilty as well. This all
occurred after my Federal lawsuit was filed and the DA said the lawsuit had no bearing on their
investigation but just after it was thrown out they walked away from my case. This has no
bearing on this lawsuit except Corp Counsel submitted the wrong notice of claim that includes
the DA and other agencies that protected NYPD crimes my case. Cy Flash Boys Vance does
fixing and favors just like top brass of the NYPD and my case is one of many. If Corp Counsel
wants to use that notice of claim so I dont have to file yet another lawsuit than I need time to
amend this lawsuit and serve everyone and I would ask help to serve Sgt Chen who is in hiding
like a klu klux clan member behind a white sheet with Bratton - Renzick help just like KELLY CAMPISI since I do not have his badge number or his first name. ADA Illuzzi stated HOOKS
complaint false, 2nd degree assault, menacing but didnt want to touch the NYPD. I reached
her 2 1/2 yrs later when I allege Dr Fagelmans patients were still harassing me online and it
appears HOOKS was discussing me w/ patients. ADA Illuzzi said she would not hold my
politics against me and the fact I am a critic of her boss. I am still calling for a special
prosector for my case from the MDs to the NYPD to Internal Affairs to Top BRASS NYPD
still KELLY CAMPISI on the record defending crimes including within the Blue Wall of
Corruption. I have email proof I forward to NYPD I contacted the DA immediately before I
was coerced by the DA brushed me off.! Right now I am asking Cy Vance to recuse himself from
the newest scandal because he and Mark Guma I allege either broke campaign laws or came very

close Exhibit 32 (June 2010 sent detailed info) and that Cy Vance owes Guma so how can he
serve Guma communications a subpoena current scandal? Just 1 ex. why DA protected NYPD IA
my case. Cy Flash Boys Vance (Charles Hynes Jr) did plenty of fixing and favors for powerful
banks, the NYPD including my case, NBA Thabo Sefoloshas case, Joe Jazz Hayden, Michael
Premo, OWS etc. If corp counsel wants to use a different notice of claim I need to amend and
serve all parties but I used 2 notices of claims from Jan 2013 that didnt have DA etc.

My opinion I want to express under oath in front of a new Commission Corp

Counsel is openly participating in protecting serious crimes including coercion, FF
bait and switch of a series of serious crimes committed by Dr Andrew Fagelmans
violent lying receptionist Delita HOOKS as well as anyone from her employers
office involved in lying to the police during an open investigation as well as the
NYPD all erased and replaced with fabricated 3rd mutual assault. I agreed to
drop charges only because I was extremely frightened of further harm and the
NYPD falsifying yet another assault at the police station lets say of a police officer
as well as even more humiliation and suffering than already inflicted including by
Det VERGONA, John Doe his partner, +DI Ed WINSKI the commander 01 Precinct
who did not respond Tuesday Oct 16, 2012 when I left him a note about the false
arrest with Lt Petrosino Memorial Pin murdered 1909 DEFENDANTS HAS SO
DEVASTATED ME TURNED PIN IN w/ note to WINSKI. This was retaliation for
many reason as explained in this opposition to dismiss which will be now public
record, historical could not be better timed win or lose I have won because this will
be public record and blasted all over the internet where I will post it hoping to

prevent corp counsel, dirty DAs like Cy Vance and Charles Hynes, dirty ADAS like
Hynes ex ADA Tacopina who in my case my guess guilty of witness tampering and
threatening me not to take action,ghost writing my attacker HOOKS letter with a
similar threat, and the NYPD, Internal Affairs to get way with murder in my case
I am speaking figuratively including I felt like VERGONA put a gun to my head.

My new exhibits are numbers and the original exhibits star w/ letters. See Exhibit K
the email I write Ron Kuby about how frightened I am of Det VERGONA; I write
to KUBY I just want to work on ECTP. ECTP is 911 Tech corruption and I had no
idea at the time of the email the NYDN would write an article exposing NYPD Chief
Chuck Dowd, Ray Kellys corrupt chief of taking gifts taking gifts from Verizon
who had to pay the city back 50 million dollars on 911. I was retaliated against by
VERGONA for his friend SCHATZ who was promoted to community affairs I
allege to do even more fixing and favors for the Mercer Hotel and others. Ray
KELLY was retaliating for all of the above and blowing the whistle on NYPD fixing
and favors including me catching a retired NYPD commander trying to fix a ticket
for a Rudin flunkie the commander and other senior retired NYPD are on Bill
Rudins pay roll and they wanted me arrested for protesting. Page 68 called DI de
Pozo dont false arrest me. I was not false arrested. 1st threat of false arrest was for
Bill Rudin who did not want me protesting outside his St. Vincents Hospital blood
luxury condos and the 2nd threat was for Dr Andrew Fagelman my guess he made a
call more on that in this motion to not dismiss. It was like a Shakespearean play and

how ironic my letter in the Wall St Journal Betrayal at Ground Zero and my
Jacket in the 9-11 Museum exhibit 20.

Besides the City owing me money I demand an apology from the the mayor of NYC,
the commissioner of the NYPD, the head of Internal Affairs and corp counsel when
there is a clean house. I would not accept apologies from the Bloomberg or de
Blasio administration because they are too corrupt and Corp Counsels role is
shameful to say the least. It may take 50 years or more but even if I am dead and
gone the City of NY is going to have to make amends to me and how many other
People including the subject of youtube documentary highly decorated NYPD Joe
Sanchez who was set-up by Internal Affairs for blowing the whistle and fired by
Charlie Ward who like Ray KELLY protects the Blue Wall of Corruption. Ray
Kelly excepted lavish gifts of plane rides for him and his wife on mayor Bloombergs
private jet & re: 911 Tech corruption KELLYs appointment of Chief of Gifts Chuck
Dowd who was not qualified to run the 911 tech division and was probably taking
compensation gifts from HP etc FirstNet which I tried reporting to Mark Peters and
did report to Internal Affairs. I am grateful Ray KELLY further incriminated
himself by having his lawyer tell Judge NATHAN he insisted on defending
VERGONA along with Campisi and all the other defendants. I prayed to G-d for
Justice and my prayers were answered NYPD app tracker a series of data base
which will make what happened to me and so many other victims impossible.

Corp Counsel submitted the wrong notice of claim see Exhibits 29 A-F for the 2
notice of claims filed in Jan 2013 used to sue the defendants in Federal Court and
when Judge Nathan referred me to NY State Court I filed this lawsuit but first by
way of Appellate Court. Note the 50-H hearing the lawyer for the City agreed to
amend the 2 notices and combine them. Page 25 see notice of claim

In the 45 days finally it has begun to come out fixing and favors at
the highest levels and mostly with Ray Kelly, Charles Campisi roots
but not my case yet.

NY Post April 14th, 2016 Title: Bratton Admits NYPD

Corruption Scandal Historically Bad Excerpt: Top cop Bill Bratton admitted on
Wednesday that the corruption scandal roiling his department is historically bad
saying the NYPD hasnt been through a darker period since the early 1970s.

It should be noted the notice of claim that Corp Counsel shared

includes Bratton his CAMPISI replacement Reznick who called a
NYPD whistle blower a rat and the whistle blowing cop sued and
won a $280K settlement; Adrian Schoolcraft 600G under Ray Kelly.
I am relieved the truth is trickling out and I can include in my
opposition to dismiss just like I did with Judge Nathan on the cover

in the NYDN Chief Chuck Dowd took lavish gifts on 911 Tech

attack at Dr Fagelmans the NYPD did Dr F a favor since he didnt
fire Delita HOOKS, 2) IA Sgt ODonnell refusing medical evidence

and email Ron Kuby proof his letter not exactly what I agreed to 3)
Sgt Chen having PO Migori turning me away 4)MY CALL TO
INTERNAL AFFAIRS RE RAY KELLYS CHIEF CHUCK DOWD gifts 911
aka ECTP possibly FIRSTNET. CORP COUNSEL IS GUILTY OF
PROTECTING WRONG DOING MY CASE.

Opposition to dismiss many reasons not to dismiss first photos from
video + DD5 so far no judges have ever looked at the evidence and
as I pro se victim of NYPD verbal violence, threatened, lied to and
lied about in NYPD police reports by the detectives involved and
their supervisors and all defendants defending coercion lying etc,
witness tampering, NYPD lying in police reports, Det John Vergona
threatening me.

Included Eric Garners pro se lawsuit handwritten

to suggest that the Pro Se offices should have check lists or even
flow charts so I question if every step of the way victims of police
crimes are failed? I hope court will look at the help instructions for
pro se people. I am suffering from PTS that continues to grow
including the shock of see VERGONA - DWYER their faces for the

first time Facebook after filing this lawsuit, the on going lies NYPD
IA, MDs office lying during a police investigation is a serious
crime and the NYPD and Internal Affairs continue to lie and defend
NYPD crimes as well as failing to properly supervise and the NYPD
are not obligated to investigate but that the issue is the NYPD are
not allowed to lie in police reports which the NYPD and Internal
affairs did, coercion, witness tampering and turn a victim away from
reporting crime which they did and I have audio proof I directed you
to and submitted to Corp Counsel as part of the Bill of Particulars
which also includes Internal Affairs Sgt Mary ODonnell refusing
evidence including medical evidence that hole in my retina now a
macular pucker and that Ron Kubys letter is not what I agreed to.
The NYPD have a responsibility to properly supervise as does
Internal Affairs and they did not. They protected crimes, abuse of
power and violation of CPR (Courtesy, Professionalism and Respect).
Compare signed Delita HOOKS letter to Kubys even more proof of
wrong doing coercion NYPD and IA fixing.
I will submit pages & pages of affidavits of service I am too tired
to list them I am alone v a huge team working on my case and has
been for years protecting NYPD IA wrong doing and note the
affidavits / process service cost me a fortune on going + letter from
Federal Court where all defendants are in it together including Ray
KELLY and the Chief of Internal Affairs CAMPISI and tell Judge Allison

Nathan they want to defend VERGONA when I sued them in Federal .

Appellate court, Corp Counsel Popolow admitted in front of 3 judges
I had reason to feel aggrieved but lied stating my Constitutional
rights were not violated. In writing he lied about me throwing a
flurry of punches which never happened lied writing VERGONA did
not know I was Jewish. I asked VERGONA false ARREST THE JEW on
SABBATH are you anti-Semitic? Vergona said he works for the
POLICE Dept. He was a government employee refused to answer
yes or no r u anti-Semitic? Exhibit J lawsuit complaint email : I
followed up with an email G-d sees all and I wrote about being
Jewish, the Holocaust suffering of my People and what he was doing
to me and dyslexically attempt to write false arrest Jew. VERGONA
knew I was Jewish!
Rosemari Nam corp counsel Federal lied on behalf of Sgt CHEN
turning me away justifying his failure to supervise and his wrong
doing turning me away stating there was no assault!

I went to get

a cyst removed on my elbow and left with a hole in my retina and cervical
damage. I became a victim of lies by the doctors office, the NYPD,
Internal Affairs even corp counsel. I posted on YouTube oral
arguments I have reason to feel aggrieved but I my rights were not
violated when I have audio proof and police reports and a video
proving my constitutional rights were violated and the VERGONA
committed the crime of coercion. Delita Hooks lied and lied during a

criminal investigation after she attacked me repeatedly and I

question whether she discussed me with patients, engaged patients
and others in harassing me during the investigation and now that I
have a lawyer and I am suing Dr Andrew Fagelman who did not fire
HOOKS but when my lawyer served Dr F the harassment on line
YouTube and Yelp finally stopped. IA said it the assault was not a
police matter!
Now the corrupt NYPD including top brass want out of this lawsuit
like rats on a sinking ship. If Ray Kelly is not a 100 percent guilty
than why not turn over Delita Hooks letter openly threatening me to
her NYPD fixer that she signed and he, CAMPISI and Ed WINSKI
push this case forward since they are 3 senior ranking officers to
clear their names? Why not face me & let me question them under
oath? The video, audio, police reports, false cross complaint hint at
why they fear being deposed.

NYPD Sgt Chen and Lt Agnes now

known to me as Lt. Michael J Agnese where impossible to find since I

did not have a first name for either one of them, Chens badge
number hidden from me; more about that dirty dealings my process
servers who attempted service including retired defendants
(except KELLY)at 1 Police Plaza, Lt Agnese of the Integrity Bureau at
Internal Affairs. Sgt Chen at 01 I was told 2 days before service
Chen was still at the First Precinct Det Squad with Det Andy Dwyer
but when my process server got there he was gone and no one I

called every NYPD det Squad in lower Manhattan to see if I can

could find him.if you let these criminal cops go it is a travesty and
I will have to pursue this either way in front of a New Commission in
to NYPD Internal Affairs DA corruption and every agency that is
suppose to police the police and fails us.

I want to make it clear that I called the NYPD legal division 1PP
after they (Rm 1406) turned my process server away. I spoke to the
lawyer there and was told that is their policy despite having
accepted service in Federal for Vergona. Popolow accepted service
in Appellate FOR ALL DEFENDANTS. I am alleging Corp Counsel
lawyers employed by the City paid by tax payers are withholding
evidence that further proves criminal actions that they have full
knowledge of by the NYPD and Internal Affairs protecting crimes
waited 45 days and than half a year to ask to dismiss my case to
protect all guilty parties. Let KELLY step forward and demand the
case move forward but all the DEFENDANTS have lost the arrogance
they had in Federal court when they knew Judge Nathan would not
look at the evidence including police reports Rosemari Nam
accidentally submitted. Judge Nathan did not even notice the public
member of the police departments notes backed up what I
reported; Lt BURGOS & VERGONA ignored the video evidence plus

NYPD Public Marks notes + Det VERGONA openly lied in the DD5
omitting HOOKS physical gesturing and verbal threat as well as the
repeated physical violence to me including with striking me with
objects on her person and how I repeatedly backed away and
alerted her she was assaulting me and that she did A RUNNING
PUNCH to my eye VERGONA OMITTED THE RUNNING PART OF THE
PUNCH - he left it all out to fabricate openly commit a crime he was
confident he could get away with and so far has. He omitted I
repeated backed away. HOOKS pursuing me and the women held
open the door all in the video!

Delita HOOKS threw her shoes not

in the DDD5 and HOOKS touched my vaginal area tagged me not

in the DD5 and that I wanted to meet with Det John VERGONA who
lied about that and refused to meet me and threatened me and was
verbally abusive and verbally violent and was confident he could lie
stating I was uncooperative. He lied about me in written word along
with my attacker Delita HOOKS in her shocking letter SIGNED
LETTER to the NYPD threatened me w/ (2nd false) cross complaint
(that would be 2nd degree assault) (exhibit 8 asked corp counsel for
letter a serious crime which IA Sgt ODONNELL read to me) if I
dared come back although not those words and she signed it a
serious crime and Internal Affairs and NYPD the blue wall with Ray
Kellys protection and the chief of IA Campisis protection. The NYPD
did a bait and switch a series of crimes including their own and

fabricated a mutual assault and in Federal had Rosemari Nam sell

their lie their was not assault. Still in shock mind blowing along w/
physical injuries from Delita HOOKS and my guess Joe Tacopina
scripted joining retaliation gang bang.

I asked to meet with the Judge for my case and was told the Judge
would meet and the defense in 30 days that never happened and
than corp counsel familiar with my case for over 2 years took as
long as possible now hoping you won't give an extension of service
which I could have asked for 30 days of filing. I did my best to reach
out to the court to try and get Justice so please do not throw out
this case. If you dismiss please explain why I am prevented from
depositions, a jury when I have overwhelming proof I was coerced. I
did not admit guilt like the Central Park 5 who just won 41 million $
settlement. JUDGE NATHAN SAID I COULD PURSUE MY CASE IN NY
STATE COURT SO HERE I AM W/ THE ORIGINAL 2 NOTICES OF CLAIM
AT 50H HEARING AMENDED.

1) Det John Vergona DD5 where he lied with malice and video grabs
from the 34 second video that Judge Nathan never looked at. She
refused to meet me and defense counsel and review video, audios
proving the NYPD violated my rights and broke the law coercing me.
If you dont allow me to move forward you and the appellate judges

will make 5 judges that never looked at the evidence and let corrupt
cops off the hook. Articles 1 -9 Omitted from the DD5 Delita HOOKS
came out from a long closed off desk to menace me! The first photo
you cant see it but the water cooler is across from the closed off

to openly fix and certainly did Dr Andrew Fagelman did not have to
fire her as well as retaliated against me for being a critic of the
NYPD along with his facebook friend NYPD PO Eugene Schatz who is
the 1st cop I reported to Internal Affairs. I think NYPD call critics
ball busters etc.

Omitted from DD5 video which was sent with photos and medical
report and Det Vergona was surprised I went to MD. He refused to
meet with me and tried to get off the phone immediately but I
insisted on talking to him and told him she yelled at me who are you
you have no rights! Omitted along with telling her no to touch me!
Omitted and the fact she touched my vaginal area with her barefoot
which is a man did that would be a sexual assault. Omitted.

said we rolled around the floor which never happened but that was
part of his lies to fabricate a mutual assault. He says the women
from the office broke up it up but the video shows them watching
even holding the door open and although they yelled to not hit me
they all lied to the NYPD and lying to the NYPD during an open
investigation is a crime.

Det Vergona said he would not talk to the

MDs because they did not witness the attack even though I told him
I asked Dr Vines assistant for help where is Dr Vine, she (HOOKS is
following me,) VERGONA refused to talk to Dr Vines assistant as
well. Dr Vine removed a cyst before the attack and came to me in
the hallway right after they attack so saw my hair on the floor, my
earring and sign protesting RUDIN luxury condos NO Trauma Level 1
hospital I wore like a big necklace ripped off me, my bloodied left
eye but when a private investigator with a his partner as witness
went in to talk to Dr Andrew Fagelman and he was asked if he
talked to the NYPD he said no comment and talk to his lawyer. Dr
Fagelman did not contact his lawyer. NOTE DR F NEVER EVEN
ASKED IF I WAS OKAY not via Dr Vine or Private Investigator. DR
ANDREW FAGELMAN DID NOT SAY YES HE CALLED THE NYPD HE
SPOKE TO THE NYPD BECAUSE DR VINES PATIENT ASSAULTED his
RECEPTIONIST/OFFICE MANAGER DELITA HOOKS BECAUSE MY GUESS
HE IS 100 PERCENT GUILTY INVOLVED IN PROTECTING HER
REPEATEDLY VIOLATING MY PATIENT RIGHTS AND VIOLATING MY

BODY AND SHE SHOULD NEVER HAVE COME OUT FROM BEHIND THE
RECEPTIONIST DESK TO CONTINUE VIOLATING MY PATIENT RIGHTS
AFTER YELLING AT ME I HAVE NO RIGHTS BUT HOW DID SHE GET THE
NYPD TO AGREE I HAD NO RIGHTS AND JOIN HER BREAKING EVEN
MORE LAWS? DR FAGELMAN STATED NO COMMENT AS IF HE HAS A
LOT TO HIDE AND MY GUESS Dr F INVOLVED IN HAVING ME
THREATENED BY THE NYPD FORCED TO DROP CHARGES COERCED
AND TO MAKE SURE DELITA HOOKS WOULD NOT BE PROSECUTED
FOR 2nd ASSAULT, menacing, FILING A FALSE CROSS COMPLAINT
AND SHE ANYONE INVOLVED IN LYING AND ALSO HARASSING OR
ENGAGING OTHERS TO HARASS ME DURING AN OPEN INVESTIGATION
WOULD BE PROTECTED. My guess Joe Tacopina contacted HOOKS
and Fagelman and ghost wrote the letter to the NYPD openly
threatening me which she signed a serious crime. Dr Vine went to
Dr Fagelman and demanded he fire Delita HOOKS. Dr Andrew
Fagelman did not fire Delita HOOKS for repeatedly violating my
patient rights, threatening me with bodily harm, lying to the NYPD
during an open investigation and I question if he also joined in the
lies witness tampering during an open investigation along with the
NYPD who lied in police reports and joined in the goal to threaten
me into dropping charges. I emailed VERGONA forwarded YouTube

comments(exhibit 11, 22 +exhibit letter I-1,2,3 ,4,5,6,7 this

lawsuit original complaint)is this witness tampering he never

answered! For some reason Dr Fagelman was confident I would be

coerced in to dropping charges with Delita HOOKS false cross
complaint she filed 2 days later.

I am alleging Dr Fagelman made

calls and got fixing and favors and that he conspired to have me
threatened with Delita Hooks false cross complaint and that along
with everyone that lied during the open investigation including the
NYPD are serious crimes and if I do not get Justice here I will
continue with the goal to finally face the criminals in front of a new
Commission in to police corruption and also a special prosecutor
and see if they will lie under oath. page the police report DD5

prevented Judge Allison Nathan from meeting with me and defense
counsel to look at the evidence which proves my case my

Hooks lied to the NYPD and you can read her false cross complaint
and how Delita HOOKS blatantly lied to the NYPD a crime and stated
I attacked her pushed her to the ground and kicked her in thigh

Burgos states he has followed up on my case 5 times upper right
hand corner many times and never once contacted me and refused
my request when a subordinate gave me his nypd email requesting

CAMPISI, ESPOSITO not a defendant, DI Ed WINSKI. Exhibit 4 shows
he never contacted me and participated in lying about me and
downgrading a series of crimes see upper right hand corner states
series of crimes to a mutual fabricated assault goal to coerce me
make the assault disappear and seal the Det Squads crimes w/
Delita HOOKS and others involved in witness tampering and
threatening me as well as lying to the NYPD who where also lying in
writing during an open police investigation a series of serious
crimes including by the NYPD and Internal Affairs that protected
them. Exhibit 3 years ignoring me lying about me refusing to answer
his NYPD email I asked for badge numbers 2015 he finally contacts
me after this lawsuit is filed asking to be added to my linked

network. Exhibit 2 Jan 2013 BURGOS wont answer my request for

VERGONA and CHENs email.

I asked for 45 days and timing perfect with breaking news of a

Federal Probe top brass fixing and favors including a savage assault
case (Exhibit 28 a-e)where the NYPD fixed like my case but I cant
confirm the NYPD lied in police reports like my case as well as
Internal Affairs in my case but it looks like top NYPD brass in on the
fixing. I fear like the NYPD infamous Ramos Case the Feds will do
damage control rather than expose city wide NYPD fixing favors &
retaliation.

I was repeatedly threatened as well as by NYPD who

joined in threatened me and lying to me and in police reports

fabricating a mutual assault. This is not me alleging but stating the
TRUTH! NYPD fix crimes like a Las Vegas Casino sometime for
money, gifts, to be invited to parties, for political reason, racism,
anti-Semitism, every ism, retaliation, to avoid paper work, to

NYPD Chief Chuck Dowds who was caught fixing crimes like my case
as many have been and he was promoted to head of Technology.

Verizon was forced to pay the City back 50 million dollars on 911 aka

than CityTIme and I was front line CityTIme the first and only person
to say do not renew with SAIC instead we need a criminal

meeting with Local 375 DC37 the biggest Union NYC gov. The NY
State Comptroller later was agreed with me and 500 million dollars

5) I have asked Corp Counsel Kari A. Heyison, Esq for Delita HOOKS
signed letter THREATENING me to Hooks NYPD fixer as read to me
and shown to me by IAB Sgt Mary ODONNEL , a letter which openly
threatens me written to her NYPD fixer telling me I better not come
back and file assault charges against her again or she will file
another (FALSE) cross complaint. (Like Tacopina style threat on
YouTube guaranteeing to see the tables turned on me.) Exhibition 8
as corp counsel lawyer that wrote the motion to dismiss, Kari A.

Heyson Esq. told me she doesnt even know about the letter. I
believe her supervisors are accountable in my case and how many
others of literally protecting NYPD crimes in my case the NYPD
committed the crimes of coercion, lying in police reports,
threatening me, protecting others that were threatening me,
witness tampering and these seasoned NYPD detectives also knew
that Delita Hooks and her co-workers lied to them during an open
investigation which is a serious crime and anyone one at Corp
Counsel knew all this along with Internal Affairs and if they can get
away with in Federal, Appellate and I fear now NY State Supreme
Court where so far no Judge or jury ever watched the video, listened
to the audios and looked at the police reports Rosemari Nam
submitted by accident in Federal Court not knowing she proved my
case but Judge Nathan did not look at the evidence I fear dismissal
again.

I cope by telling myself I will bring this to a new

Commission in police corruption along with how many other victims?

I hope film makers and authors exposing corruption will use my
lawsuits to share with as large a world audience as possible like the
success of Oscar awarding film Spotlight I believe the truth will
come out my case, so many other cases including for former
decorated NYPD Joe Sanchez the subject of my YouTube
documentary set-up by the NYPD IA for being a whistle blower.
NYPD posters encourage NYPD to blow the whistle, contact Internal

Affairs but name 1 NYPD whistle blower who did not suffer
retaliation. I am not going to let anyone get away with what they
did to me and I hope to make it a lot harder to continue what clearly
is systemic corruption protected by Corp Counsel Zachary Carter
and his predecessor re: my case.

My goal to testify in front of a new commission in to NYPD Internal

Affairs and DA corruption and I want corp counsel lawyers to answer
under oath why they defended NYPD IA crimes my case and so many
others. Page 6 Dont dismiss this case it is crucial in an era of NYPD
corruption to move cases like my along to allow me discovery
depositions and for me to face the men that hide their faces and
badge numbers as well as supervisors that are on record in Federal
court including Ray Kelly defending coercion, lying in police reports.

If you cant than I ask you rule in favor of a default because the City
took 45 days to respond and One Police Plaza refused service on
retired NYPD except Ray KELLY.

The help desk said the judge

would meet with me in 30 days and in fact to allow the judge even
more time because of the holidays and the help desk seem to think
my materials were enough to serve the NYPD and all involved which

I did the best I could as a pro se litigant.

I have asked for an

extension of service to go after Sgt CHEN no first name or badge

number and Lt Michael J Agnese aka AGNES and that Corp Counsel
accept service for everyone like Corp Counsel did in Federal Court.
Based on the holidays, the City of NY corp counsel taking 45 days to
respond and almost half a year to send in a series of so many
amended responses I have lost track if you cant move this case
forward than you must rule a default that is not Justice but will at
least for the City to continue to face the wrong doings . Major
REFORM needed including full disclosure on Corp Counsels website

If tax payers could

vote on whether they wanted their tax dollars to represent these

cops based on the Youtube of the attack, the 3 audios of NYPD and
IA I have submitted as well as the police reports their defense
attorney accidentally submitted not understanding they prove I am
the victim of the NYPD falsifying a savage attack and a series of
crimes in to a bait in switch mutual assault the tax payers would
have said no. The City could have settled this for 50,000 dollars
before my Dad died and time had run out to sue my attacker for a
million dollars and my Mom who is dying the damage continues
and if you throw this out than at least you will have to look at Eric
Garners pro se hand written lawsuit that was thrown out because

Det John Vergonas DD5 his own defense attorney Rosemari Nam
submitted w/ police reports where he blatantly lied with
supervisors protecting him even omitted me repeatedly backing
away trying to get away from attacker HOOKS. You can see from
the video there is nothing mutual as Delita HOOKS repeatedly
attacks me as I repeatedly back away documenting her violating my

WINSKI never met with me regarding the 01 Det Squads
investigation and protected a cabal of lies about me and protected
fabricating a series of crimes from the MDs office to the 01 Det
Squad coercion, lying in police reports, threatening me, yet Lt
BURGOSs concede in his police reports that they are investigating
more than just assault 3 and commanding officer DI Ed Winski

statistical report for Oct and Nov 2012 was fixed to omit a
series of crimes including commited inside the 01 Precinct
THE NYPD DONT HAVE TO INVESTIGATE BUT THE NYPD AND IAB ARE
NOT ALLOWED TO LIE commit crimes AND PROTECT CRIMES AND
PARTICIPATE IN COERCION LYING. THEY DID!

Lt Burgos, Sgt Chen

and any supervisor looking at police notes saw I submitted the

video and photos plus medical and Delita Hooks letter response to
Ron Kubys brief note short hand for my client is being coerced
where he wrote I would drop the charges against my attacker if she
drops the alleged charges vs HOOKS signed letter OPENLY
THREATENING ME AGAIN WARNING ME TO NOT COME BACK AGAIN
OR SHE WILL RETALIATE AGAINST ME AGAIN with the NYPD
protected her!!!!!

I did not even know DELITA HOOKS name- no

one wears name tags. The NYPD that did their round robin
round robin investigate the victim than play their judge and jury
and it was decided to coerce me threaten me and lie in police
reports make this go away. NYPD do this to keep crime stats down,
to avoid paperwork or as an act of retaliation.

NYPD re-opened my case numerous times and will fully ignored

evidence of NYPD wrong doing along with Internal Affairs. Please
do not let them get away with it. They will be laughing at you at
much as me but the day I get them in court answering questions

under oath they wont be laughing any more and if it is not here
than it will be in front of a new commission in police internal affairs
da corruption because too often DAs and ADAS protect NYPD IA
wrong doing.

answer my email to him his subordinate gave me his NYPD email

violence and lies to the NYPD Det Squad and all supervisors

Dwyers existence at the time but he clearly was party to the
criminal act of fixing coercing me threatening me and lying in

I took my email to Lt Angelo Burgos and mailed the email snail mail
to NYPD Commish Ray KELLY, NYPD Chief Esposito, Internal Affairs
chief CAMPISI, DI Ed WINSKI and got no answer. I asked CCRB and

email along with all supervisors including Ray KELLY asking for
badge numbers. He had Chief Lowell Stahl and DI DeQuattro
respond mentioning Ray Kelly, when I wrote praising the NYPD and
had a positive relationship.

After I filed in appellate I allege the NYPD stole the identity of a

alerted Mr. Weaver and he is now my Facebook friend. NYPD. I
allege NYPD stalked me on line and 1 ex. stole racist cop said via
diplomat de Weavers identity shut up you are on the losing end

behalf of the NYPD? U defend Black People Poetic Justice a Black
Person assaulted u dumbcuntlivesmatter? See NYTime photo

great and was happy written up in The NY Times helping Giuseppi

I prayed to G-d to help me with INJUSTICE and prevent the NYPD

from doing to others in the future and I came up with the concept of
NYPD app tracker data base for victims to find each other report
crimes NYPD IAB DA wont allow us to report including their own as
well as database of all lawsuits against the City, FOIL requests. A
fellow victim could me corrupt cops my case badge #s.

It seems the City of NY and corrupt NYPD and internal affairs

involved in my case and their team took advantage every way
possible starting with taking 45 days to respond instead of 20 days.
I had sued them in Federal and they lucked out Judge Nathan who
never met me refused to have a meeting and watch the video and
audios including of the NYPD turning me away preventing me from
reporting Deltia Hooks false cross complaint, IA Mary ODonnell
refusing evidence, the attack video and police reports that proved
the NYPD lied in police reports and fabricated a savage one way
assault in to a girl fight when I was a patient used as a human
piata for Delita HOOKS who has anger management problems and I
fear so does Det VERGONA from his verbally violent tone and his
threats to false arrest me but he denied it was false he said I
assaulted her - I told him I have never assaulted anyone and I never
even got a detention in high school. Delita HOOKS assaulted me
VERGONA lie to me and in police reports a serious crime to
fabricate police reports and I have the video proof, police reports
so why did Internal Affairs under Ray KELLY allow VERGONA to retire
and collect his pension along with Lt. BURGOS? I was treated like a
Jew in the Early Stages of Nazi Germany and as values as a Jew from
that era Nazi Germany. KELLY CAMPISI and than BRATTON Reznick
allowed Sgt CHEN and det DWYER to stay at 01 Det. Squad. Team

Bratton actually moved CHEN 2 days after I called and verified CHEN
was there for my process server!

I spoke to the NYPD lawyer 1PP room 1406, why did you turn my
process server away.well now I see how corrupt NYPD and IAB hid
their crimes w/ NYPD legal and corp counsel legal it a scrum
protecting the cowards who behave like Klu Klux clan members and
so after my process server turned away with this lawsuit, I went to
facebook and found NYPD Det John Vergona now has a face book
page and who is his facebook friend for the first time I saw their
faces and learned of their special friendship w/ PO Schatz and Det
Moran first precinct community affairs part of fixing favors
retaliation gang?

Exhibit 15 McClifford Genois posted a comment on the assault

YouTube after looking at my posts (like perhaps Det Vergona and
his supervisors aka NYPD term round robin) you are a blogger and
thats what you do for a living .you got what you got what you
deserved. I looked him up on linkedin says Global Elite Group US
Army, Law Enforcement please take a good look at Exhibit 15

Ron Kuby agreed to represent me if I went through the process of

false arrest but wanted nothing to do with the case if I dropped the

3rd degree assault charges and went to IAB and CCRB which I did.
His letter is not what I agreed to as the email I tell IAB Sgt Mary
ODonnell in audio Exhibit 31 she agreed to let me audio tape of her
refusing the evidence.

I am grateful he guided me out of further

danger as the audio so far Judge Nathan, 3 appeallate judges and

now you will not Listen to you can hear ODONNELL refusing
evidence stating case closed. Even the lawyer who that ghost wrote
the Tacopina style letter for Delita HOOKS recognized I could come
back and file 2nd degree assault charges but not one NYPD officer
or Internal Affairs officers told me that was an option. I only learned
that from a p.o. at another precinct by sheer luck during Federal
lawsuit I could report 2nd degree assault since corp counsel Nam
said no assault I dropped charges. Friday Sept. 27, 2013 I wanted
Judge Nathans protection but didnt get it when I learned I could
report 2nd degree assault despite being coerced by VERGONA to
drop 3rd degree from p.o. different precinct so when Rosemari Nam
of corp counsel told me there was no assault which was a blatant lie
and I called her from the First Precinct to tell her the 1st Precinct
Det squad had indeed re-opened the case so yes there was an
assault v her stating no assault and yet again I was turned away
prevented from reporting a crime by the supervisor Lt Hendrick (not
from the Det Squad) who told me the Det Squad refused to allow me
to upgrade the assault charges to 2nd Degree and because I was

suing told me via a supervisor downstairs and I was told to leaveI

informed Judge Nathan as well as asked her for a court monitor to
escort me to the 01 Precinct because I was afraid. Instead I gave
defense attorneys a retainer I was so frightened just in case NYPD
under a new CO tried to harm me or false arrest me.

The NYPD hid their identities like Klu Klux clan members and I was
never allowed to know Sgt CHENs first initial or his badge number.
Two days before I filed this lawsuit I called the first precinct and got
confirmation both Sgt CHEN and Det DWYER were there. I can only
guess the NYPD know how serious his role is in the role of
COERCION, threatening me and lying in police reports and moved
him out counting on the fact I would not be able to track him down.
Sgt Chen was suppose to come down as protocol requires and face
me when he violated procedure and my rights preventing me from
reporting my attacker Delita Hooks false cross complaint but he like
all involved in the det squad hid their identities like Klux klux clan
members. It was a shock to finally see Det Vergona and Andy
Dwyers faces for the first time on Facebook after 1 Police Plaza
refused service for all retired NYPD.
So far it feels to me like Justice is a gated community and People
like me especially pro se litigants are treated like unwelcome
visitors to be politely tolerated and the help desk information

especially NY Supreme Court my opinion horribly complicated and

hard to understand and the only office to close for a lunch break so
pro se litigants are forced to sign a sheet and sit and wait for the
office to re-open. I also have spoken with the Supreme Court
support staff and if I dont ask for financial assistance I believe the
5 books to present my case would cost way more money than I have
spent already a lot more.
If I had at age 50 with a hole in my retina and cervical damage
allowed myself to be false arrested on Saturday than Ron Kuby
would have represented me and I am confident we would have won.
I can not express the level of fear I was chilled the legal term
truly frightened and part of the PTS is I cant stop talking about this
and the MDs office and I wont until I get Justice and than I can

I was on 3 medications for pain when VERGONA

succeed in forcing me to drop charges against my will as I dealt with

Both Det John Vergona and Ron Kuby knew I had a collapsed bladder
I still have it from fibriod tumors - result frequent urination
even HOOKS knew 1st time I walked in there I asked for the key

because of this problem. VERGONA knew this would have added to

the weekend of hell he had planned for me if I did not drop charges.
VERGONA did not care; VERGONA violated: due process, my
Constitutional rights, the law and he treated me like a Jew in the
early stages of Nazi Germany like Delita HOOKS he decided I had no
rights her words before she savage assault.

I had a hole in my

retina that had yet to be repaired a ton of floaters from Delita

Hooks repeatedly pulling my hair yanking me trying first to drag me
down the hall by my hair (not in 01 Det Squad DD5s) and than
pulling me to her to try and kick me in the groin and when she
couldnt pressing her barefoot against my vagina area tagging me
part of her on going abuse of power and VERGONA has abused his
power horrifyingly on the phone. What would he do to me in
person, he already told me he didnt care if I had 2 black eyes stop

I feared the NYPD would harm me maybe further

assault me, or fabricate another assault this time against an NYPD

officer or sexually degrade me.

back in public. The NYPD said to Eric Garner we know who you are,
the Parks Dept should not employ you, you are a felong. I have no
record. The NYPD did a Round Robin on me and the 01 Precinct
was very familiar with my activism even protesting right outside
their precinct their harassment of Veteran Vets and Artists vendors

for the Mercer Hotel. The NYPD know I am a whistle blower activist
who also joked about an NYPD detective Pepe that lives on Staten
Island who cheated on his wife with a separated woman whos
husband came in and took NYPD Pepes gun and shoot him in the
buttocks.

and how the NYPD call everything affairs community affairs,

internal affairsmake you wonder. I was writing about this when
VERGONA also a detective from SI was doing his round robin.

Det John Vergona had already been verbally violent and abuse as
well as threatening to me and humiliated me with his lies telling me
I assaulted her and she assaulted me even steven a term Internal
Affairs Sgt Decker would explain means mutual assault and Ron
Kuby expressed concerns for what would happen to me when I got
to the precinct. I knew the NYPD who I have audio of them lying to
me as they turn me away from reporting Delita Hooks false cross
complaint were and are capable of fabricating anything they want
they could lie for instance and say I assaulted PO Migori and throw
me on Rikers and give me the Eric Garner treatment he powerfully
documents in his lawsuit (Exhibit 16a-16f) that no media outlet has
shared Eric Garners hand written lawsuit and the NYPD control
press passes. The NYPD would go to lengths to prevent me from having a press
pass.

I feared the NYPD would continue their lies and violence far worse
and fabricate even more wrong doing maybe even fabricate a fake
assault on a cop and sent me to Rikers or sexually violate me the
graphic way Eric Garner describes in his lawsuit. Exhibits 16 A-F
Eric describes sexually publicly violated by NYPD who plant drugs
on him retaliating because he was suing. Det VERGONA already
retaliated against me probably laughed w/ facebook friends DWYER,
det Moran and community affairs partner SCHATZ and who knew
what VERGONA had planned next if I had turned myself in for false
arrest on the weekend.

Delita Hooks threatening letter that sounds like Joe Tacopina wrote
it the letter is similar in tone threatening me like the
confrontative cunt letter too much of a coincidence my guess
Joe Tacopina and if so he commited yet another crime and got away
with it if I am correct and the Feds caught him doing something
criminal and gave him a free pass to turn on his best friend client
and biz partner police commissioner Bernie Kerik and because I did
confront Joe Tacopina when he walked up to me where I was
standing and I caught it and posted on YouTube just like I posted his

secretary telling me the NYPD rape cops were going to get off
before the jury had even ruled.

If I cant get Justice than I am asking for a default because the City
took so long to respond and I immediately asked to meet with a
judge and it never happened and the help desk said allow extra time
for the holidays but that was clearly a mistake.

I was and I am being treated like a Jew in the Early Stages of Nazi

police reports that corp counsel accidentally gave me in Federal

The notice of claim corp counsel submitted is not the one for this
lawsuit. I fear the Judge is just going to dismiss this case anyway
but for the record that is not the notice of claim as it is dated after
Judge Nathan ruled and I am here in NY State Supreme Court only
because Judge Nathan said I could pursue my case in NY STATE court
form 2 notice of claims the City lawyer in the 50H hearing agreed to
modify and role in to one and I have transcripts of the 2 50H
hearing back to back we did ultimately agreeing to one and that was
from a notice of claim from Jan 2013 and than I filed in the lawsuit in
Federal in 2013. If Corp Counsel want to focus on this notice of

all along I tried to report harassment to Internal Affairs but they
refused to hear any of it. See exhibit 31 but on page 6 of this
opposition.

The NYPD did investigate to some degree so the issue is not that
they did not investigate the issues is the NYPD detectives agreed to
threat me, coerce me, lie in police and seal their crimes with a
series of Delita Hooks.

I am alleging the city of New York corporate counsel purposely put the wrong notice of
claim in their motion to dismiss to rob me of the chance of suing the Manhattan DA
which they are fully aware of I have audio of ADAs lying to me. NBA Thabo Sefolosha's
lawyer is my linked in friend and I can only hope and pray that if I come back in the next
two years I come back with the lawyer like him because I've no doubt he sue the DA for
malicious false prosecution.
This lawsuit was and is a continuation of I lawsuit filed in federal court based on two
notices a claim that the city of New York rolled into one and modified during the 50-H
hearing by the lawyer for the City with my agreement.
Notice of claim presented by the city instructing you to dismiss my case was filed after
the federal case was thrown out and includes new Police Commissioner, new head of
internalAffairs, the Manhattan DA and 3 ADAs

I want to make it clear in response to the city that I have a right to pursue them and that
was wrong of them to put this nurse a claim in this lawsuit response to dismiss and I'm
alleging their goal was to prevent me from pursuing Justice via another lawsuit.
Lt BURGOS email asking to be linkedin friends yet Lt BURGOS never contacted me
once until NY State Supreme court in anyway -refused to answer my emails asking for
badge numbers a subordinate gave his NYPD email to request badge numbers and I
mailed that request to DI Ed Winski, Ray Kelly, Charles Campisi and than chief of dept
Esposito.

See copy of letter Rosemari Nam defense counsel saying all defendants stand by Det
Vergona and wanted him defended. He had retired and the defendants had their lawyer
instruct me to serve him at 1 Police Plaza.

My point is this is a continuation of the lawsuit in Federal Court under Judge Nathan
who referred me to NY State Court has nothing to do with the notice of claim Corp
Counsel submitted which came after and that this letter EXHIBIT 5 I am submitting I
am asking to not allow Ray KELLY or anyone off the hook because they clearly have
aligned themselves with Det John Vergona who clearly and openly committed a series
of crimes, threatening me. coercion, lied in police reports fabricating a mutual assault.
This letter should cover any concerns of serve and should be considered in terms of the
City of NYs tardy response 45 days late plus I asked to meet with a judge and was told
by the help desk that would happen in 30 days and that did not happen and One
Police Plaza turned away my process server for retired NYPD Charles Campisi ex
head of Internal Affairs, Det John Vergona who I would later find on facebook
after 1 PP rejected service and would be shocked to find he is facebook friends
with Det Andy Dwyer the corrupt det I call Delita Hooks detective they hide

their faces and badge numbers like Klux klux clan members did not meet with
meet lied about me in police reports and conspired to coerce me and than seal
their crimes with Delita Hooks including the letter she signed to the NYPD
threatening me yet again; a serious crime same threatening tone my guess the
same author Joe Tacopina I am guessing he used the sock puppet accounts
along with a friend to call me a confrontative cunt, warn me to come forward or he
would see the tables were turned and he would bury me and destroy me.

If the court throws out my case on a technicality than I feel I have been failed by a
Federal court; there was enough there but I could not get Judge Nathan to even
meet with me once in person and she refused my request to meet with me and
defense counsel to look at the video, listen tot he audio of Sgt Chen having PO
Migori turn me away preventing me from reporting Delita Hooks false cross
complaint which was a violation of my constitutional rights I caught on audio,
Delita Hooks false cross complaint and all the NYPD police reports Rosemari
Nam defense counsel submitted by accident proving my case plus audio of IAB
Sgt Mary ODONNELL refusing evidence I wanted to fax her medical plus Ron
Kubys letter was not what I agreed to. I am pro se and is it fair under
extenuating circumstances for a judge or judges to look at the evidence?

I asked appellate judges to listen to the audios and look at the video and police
reports but they did not and now I included audio of Internal Affairs stating Chief
Chuck Dowd did not still millions on 911 and FirstNet. I testified at City Hall and I
gave Dowd and Ray Kelly my Justice Cards that stated clearly I was coerced and
that the NYPD fix crime like a Las Vegas Casino

It was impossible to serve NYPD hide their identities their policy is they do not
have to give out their first name so there is no way I could track Sgt Chen and
every supervisor at the First Precinct and One Police Plaza including Kelly,
Campisi, Esposito refused to give me badge numbers. The Wheel said they are
too many Sgt Chens, 3 days before I was to serve Sgt Chen the First Precinct Det
Squad confirmed Sgt Chen and Det Andy Dwyer were there but when my process
server had arrived he had vanished and I called every Det Squad in lower
manhattan to find him.

I had the process server follow up my mail and we sent back up to the First
Precinct and Internal Affairs for Lt Agnes know revealed to be Michael J. Agnese
as of 2016. I had the process servers follow up with mail for Sgt Chen at the 01
and Lt Agnes w/ Internal Affairs and the mail was not returned. I called the

Integrity Unit asking for supervisors and I was told there are no supervisors
and that they had no idea where he is. The Wheel said there was no lt Agnes.

I now can locate Lt Michael J Agnese because I have his FIRST name and correct
spelling of his last name unlike Sgt chen who is guilty along with all involved and knew I
was to be threatened with a false cross complaint. In Federal and Appellate in the
lawsuit responses corp counsel lawyers did not fix the misspelling or offer a first initial.
Besides being lawyers they are paid by the tax payers and lawyers for the City should
not be protecting coercion, lying in police reports, failure to supervise and violating
protocols as well as my Constitutional rights and breaking the law.
Sgt Chen had told me over the phone begrudgingly I was correct I have a right to report
the false cross complaint it is a crime and to come down and I sent Corp Counsel video
and audios all I referred the court to like Judge Nathan to Youtube because DVD can
fade be cracked or broken but the evidence is up there on YouTube.
I successfully had process servers serve Det John Vergona at his home once I found
his facebook page and found he was married to Susan Balzan Vergona I discovered
where he lived on Staten Island and served him (I ALSO HAD TO DEAL WITH SEVERE
PTS FINDING OUT DET JOHN VERGONA IS FACEBOOK FRIENDS WITH DET ANDY
DWYER AND SEE BOTH THEIR FACES FOR THE FIRST TIME and they are facebook
friends with NYPD Po Eugene Schatz who is the first NYPD officer I reported to Internal
Affairs for threatening me and lying to me, illegal use of his sirens video posted on
YouTube and his partner Det Tommy MORAN all Facebook friends I learned Nov 2015
shocking to me.. Facebook friends all in on retaliation? I took video and photos.) DI Ed
Winski was properly served as my process servers United Process Servers can confirm
I believe they handed in a copy to the court I served everyone but I am also asking
the court to consider Rosemari Nams letter and the fact all defendants stuck together in
Federal Court and no one asked to be excused!
The guilty parties benefited from the City taking 45 days to respond! The guilty parties
benefited from me not me with a Judge immediately within 30 days so we could discuss
service of the defendants and now they dont want to take responsibility most of all Ray
Kelly who defiantly defended blatant violations of my constitutional rights, laws being
broken including coercion, lying in police reports in Federal Court VERGONA lying in

police reports about the savage one way assault that included my attacker pressing her
barefoot against my vagina if a man did that that would be sexually assault but it is
not even mentioned in the DD5 along with so much more Det John VERGONA omitted
and in the evidence section there is enough to move this forward to depositions and
they are so guilty and want you to let them off like all the other judges.
They are guilty they are wrong and it is powerful to me that DI Ed WINSKI asks to be
excused when I have proof he was served at his office via a subordinate at 1 Police
Plaza; a subordinate accepted just like NYPD at the front desk accept service at
precincts which his what happen with IAB sgt Mary ODonnell, Det Andy Dwyer, 1PP
Ray Kelly I got enough people served and the City and the Police dept

Eric Garner is dead and I am alive both of our Pro Se lawsuits I believe would
become history - proof we could not get justice because of technicalities? We could
not get Judges to look at overwhelming proof the NYPD crimes they are not properly
supervised and is anyone surprised NYC is being threatened with riots?
I do not believe in rioting. How about Pro Se offices giving simple check lists?
A simple check list might have saved Eric Garners life. If I am harmed further or
murdered my efforts in Federal, Appellate and NY State Supreme Court will be
documenation.
Activists, police historians are following my case and how there is over whelming
evidence but I cant get one judge to look at the video of the attack, listen to damning
police audios and police reports which proved the NYPD lied and that plain to any police
investigator as was Delita Hooks false cross complaint and her bigger crime signing the
Joe Tacopina styled letter to her NYPD fixer warning me not to come back READ to me
and shown to me by NYPD Sgt Mary ODonnell who said cased closed when in fact she
just showed me yet another crime. Even Delita Hooks joe Tacopina letter recognizes I
could come back and file 2nd degree assault charges which is actually the crime she
committed hitting me with the phone, keys on her wrist which left defensive wounds on
my forearm.

Rosemari Nam told me I was not assaulted so case closed so I called her from the
precinct and alerted her she had told me wrong information and in fact the case was
OPEN! I was told my case was open but the NYPD would not let me upgrade it.

Rosemari Nam said Sgt Chen PO migori turned me away because there was no assault
but that was a flat out lie. I was assaulted and audio you can hear PO Migori state I am
not a detective or from the DAs so I cant report it. That is simple wrong. Retired NYPD
Capt John Eterno expert on crime and Prof Dr Eterno Molloy University confirmed to me
they are not to turn me away but allow me to report a crime and put the allegations in
both my file and Delita Hooks file.

In the audio Sgt Chen refuses to come down and face me and answer my questions
which is a violation of protocol and again a failure to supervise as guilty and wrong as DI
Ed Winski who you can hear me ask for him, Internal Affairs and I call CCRB and I
included the letter to WINSKI in the original lawsuit evidence section - WINSKI and
KELLY who did not want to get out of the Federal lawsuit but now Ray Kelly and WINSKI
want out.

I am including Eric Garner in his own words and I worry if I will come to further harm like
he did, the worst kind as a global audience witnessed.

no doubt the defendants and other involved behind the scenes did what they did to me

NY State Supreme Court when 1 Police Plaza refuses service for retired Det Vergona I
found he is on facebook his facebook FRIEND Delita HOOKS fixer detective they are
facebook friends with NYPD PO Eugene Schatz the first NYPD officer I ever reported to
Internal Affairs for illegally using his sirens on his car to get to my 15 minute protest for
Veteran and Artist Vendors at the Mercer Hotel where he also used his NYPD car an
aggressive threatening gesture to yell at me the Mercer Hotel can illegal park their cars
in the loading and unloading zone -NYPD PO SCHATZ was aggressive I reported
his threatened dishonest behavior on behalf of The Mercer Hotel and than
surprise who is even MORE THREATENING but SCHATZs facebook friend Det
VERGONA over the phone refusing to meet me and lying about refusing to meet
me in police reports and the misogynist corrupt NYPD Det John Vergona lied
stating I was uncooperateive and his corrupt supervisors backed him up rather
than meet with me because I was branded a trouble maker.

If I am a trouble maker I am sure King George called our Founding Fathers and Mothers
trouble makers it appears the NYPD Internal affairs do not understand that I still have
Constitutional rights and the NYPD do no get to break the laws and retaliate against me.

Rosemari Nam had also told me the detectives had sealed Delita Hooks file and
mine and it was clear to me the corrupt dirty detectives with their supervisors and
Internal Affairs protection sealed their crimes with Delita Hooks crimes as well
anyone at the office that lied to the NYPD and Internal Affairs during an open
investigation which is a crime as well as NYPD lying in police reports and Internal
Affairs lying as well.

One IAB officer who answers there phones told me it was not a police matter so they
forwarded my case to NY Dept of Health. I spoke to a lawyer there who said they had
no record of IAB (Internal Affairs Bureau) forwarding the case but I was assaulted.

Lt Agnes now known to me as Lt. Michael J. Agnese of the Integrity Bureau never
returned my calls. When I asked for his supervisors I was told he had no supervisors.
IAB Sgt Decker told me Lt Agnes (Lt Michael J Agnes) of the Integrity Bureau would
interview everybody which is what the liar corrupt Det John Vergona told me and he did
not. This was not an integrity issue but a criminal but even so Lt. Michael Agnese
along with IA was going to fix it and not interview everybody but protect NYPD lying in
police reports there by becoming accessories to crimes. Vergona also refused to
interview Dr Vine and her assistant who broke in to the office to get Dr Vine to help me!
The NYPD do not have to investigate but clearly everyone involved investigating was
going to violate protocols preventing me from talking to supervisors as well as the law

being party to coercion and protecting lying in police reports or NYPD and Internal
Affairs officers lying and with Ray Kelly and Charles Campisis protection. My next
lawsuit will include Bratton and Chief Reznick chief of Internal Affairs who calls whistle
blowers RATS!

I want corp counsel and everyone involved to have to answer questions about my case
under oath including many top officials in the NYPD and Internal Affairs whos names I
do not have as well as the partners of the all involved whos names I do not have plus
IAB Sgt Kroll the only honest person I spoke to who admitted I had time to pursue
assault charges against Delita Hooks he accompanied Sgt ODonnell but told me she
was in charge.

I am asking you to move this case forward and allow me finally to hold Delita Hooks
letter a serious crime in my hands.

I am asking you to move this forward so the NYPD may think twice about what they did
to me and how many other victims? If you cant you cant but do you wonder why they
are massive protests against the NYPD and People yell about the Injustice system?
Delita Hooks lied and lied during a criminal investigation after she attacked me
repeatedly and I question whether she discussed me with patients, engaged patients
and others in harassing me during the investigation and now that I have a lawyer and I
am suing Dr Andrew Fagelman who did not fire her but when my lawyer served Dr F
the harassment finally stopped.

Do not dismiss this case which will be part of history because of NYPD IAB DA
corruption as well as because I am number one most enduring vocal whistle blower on
911 tech corruption bigger than CityTime and it involved top brass NYPD wrong doing
as well as taking lavish gifts.

Do not dismiss this case or default this case because Corp Counsel took 45 days to
respond and even submitted the wrong notice of claim my guess trying to rob me of
going after the DA and ADAs with damning secretly recorded audios of them lying to

Corp Counsel will one day I hope and pray answer for their actions regarding my case
and others under oath. Already People are asking me why corp counsel has not offered
me a settlement and how they could defend such blatant wrong doings.

I prayed to G-d to help me because I dont believe in riots and I want Justice and my
prayers to some degree have been answered. I came up with the concept of The NYPD
APP Tracker a series of data bases including the NYPD crime stats but the NYPD App
tracker allows victims to report crimes including NYPD crimes so in my case I could
report 2nd degree assault, menacing, a false cross complaint, Dellita Hooks signed
letter to the NYPD threatening me yet again, NYPD Coercion, NYPD lying in police
report, NYPD Det John Vergona threatening me yelling at me over the phone if you dont
drop the charges I will arrest you.

The NYPD app tracker will be a series of data bases that allow victims to better hold the
City of NY accountable that will allow victims to map crimes, lawsuits, find each other
and also share information like yes I was coerced by that Detective as well - you dont
have his badge number here it is !

NYC comptroller has an application for lawsuits so it need to be turned over to the
NYPD app tracker to track all lawsuits NYPD, DOT (dept of transportation) DEP we can
map the Citys wrong doing lets say neglecting an intersection where People keep
getting killed or a precinct or NYPD official who keeps getting sued

NYPD app tracker will track all FOIL requests and see why the mayors office to the
NYPD are refusing to answer the FOIL requests.

I donated my white blood cells twice to strangers, one a little girl one non hodkigns
cancer a hispanic male at Newark Hospital lymphoma after Sept 11 despite having
knee surgery I went down to my health club and massaged 100s of NYPD in the lobby
along with military officers for free, I volunteered with pre school handicapped children at
NYU rusk and later after 9-11 went back to the volunteer office and worked an archive of
