I refer to your letter dated 13" March 2015 received by email on 18" March 2015
ani = requested thal we investigate a new complaint against our member, Ms.
Talso refer to your letter dated 28" May 2015 to Ms. Fiona McGuinness which she
has passed on to me and would ask that you note that I acknowledged receipt of your
letter dated 13 March 2015 by email dated 23" March 2015 and that you responded
to that email on the same day.
We have carried out a preliminary review of the information you provided and have
conchided that the matters relating to confidentiality about which you are complaining
are the same as those which were the subject matter of your complaint against the
member in 2013, complaint reference no: 13/09/099, and that the information now
provided would have been available to you at the time of the investigation of that
complaint,
Complaint reference no: 13/09/099 was fully investigated by the Complaints
Committee who found that a prima facie case had not been established. The
Complaints Committee's decision was subject to Independent Review at your request,
‘The Independent Reviewer refemed the matter back to the Complaints Committee
who considered the matter afresh but again found that a prima facie case had not been
established. You have been informed that the complaint is now closed.
You have also raised issues pertaining to evidence provided by the member in
connection with her complaint against you to the ACCA. Any issues relating to such
evidence are a matter for consideration by that body and should not be the subject
