F.I.R.

An FIR was lodge against durvijay gupta for killing his 9 month son sumit. The FIR was lodged
by usha devi w/o durvijay gupta and mother of sumit. According to FIR usha devi w/o durvijay
gupta went to her mother home to attend her brother marriage. On 12/05/2015 durvijay gupta
arrived at the marriage and start claimimg that their 9 month son sumit is not their legitimate
child and he said he will kill him. On 16/05/2015 morning at 3:00 am durvijay take both of his
children along with his sister jyoti gupta on moter cycle, usha devi even tried to stop him but she
fails as his family said the children are his children too. After some time jyoti return, she said that
durvijay take them to rajghat bridge situated on river rapti near Gorakhpur, U.P. and he threw his
9 month son in the river. Jyoti sister of durvijay saw sumit drowning in the river. She didnt said
anything because she got afraid. After some time she called the police and searched for sumit but
they fail to find him. In the police station durvijay said sumit was not his legitimate son and he
said his wife has physical relationship with other man. He said that he threw sumit in the river at
3:30 am.

ABSTRACT
I am going to file a quash petition in the High Court of Lucknow to quash the case that was
foisted against my client named Durvijay Gupta son of Chandrika Gupta, Indian, residing at
maheva chungi, khorabar, Gorakhpur, U.P. registered F.I.R. NO. 0095/2015 on 17/05/2015 by the
Inspector of police, Belipar Police Station, Under sections 201, 302 of Indian Penal Code for
killing his own son because he think his son was not his legitimate son and his wife is having
physical relationship with other man.
