havingbeendulysworninaccordancewithlaw,doherebydeposeandstate
that:
1) IamthepresentGeneralManagerofCHARIOTTRAILER
LEASINGCORP.,saidcompanybeingadomesticcorporation
engagedinthebusinessoftrailerleasingandotheralliedserviceswith
principalofficeatRm.111BNorthPointBldg.,LowerGen.Luna
rd.,BaguioCity,hereinafterreferredtoas"CTLC"forbrevity;
2) Alongwithmydutiesandresponsibilitiesassuch,istorepresentthe
companyinthecasesitfilesbeforeanycourt/tribunal/judicialagency
inordertoprotectitsinterests,asmanifestedinthehereinattached
SecretarysCertificateandhereinmarkedasAnnex"A";
3) Asmentionedabove,CTLCisengagedinthebusinessoftrailer
leasingandotheralliedservices,andamongitsclientsisa
establishmentengagedintruckingbusiness,knownasWINSTON
CHARLESMARKETING"ownedandmanagedbyMR.
HONORATOC.SAMSON&MS.LUISAV.SAMSON;
4) Saidbusinessestablishmenthasitsknownofficeaddressat#667
CabinetHill,BaguioCity,asrepresentedbyitsOwners/Proprietors
MR.HONORATOC.SAMSON&MS.LUISAV.SAMSONwith
thesameresidenceaddressattheaforementionedbusinessaddress,
whoareauthorizedtoacceptsummonsandlegalprocessesinalllegal
proceedings&allnoticesaffectingtheaforementionedestablishment
atitsaforementionedbusinessaddress;
5) OnvariousdatescommencingfromSeptember2015uptoDecember
2015,MR.HONORATOC.SAMSON&MS.LUISAV.SAMSON,
doingbusinessunderthenameofWINSTONCHARLES
MARKETING,engagedtheservicesofCTLCinfurtheranceoftheir
businessactivity.Inthecoursethereof,WINSTONCHARLES
MARKETINGhasincurredseveralunpaidobligationstoCTLC;
6) CommencingfromSeptember2015,WinstonCharlesMarketinghas
failedtopaytheiraccountsregularlytoCTLCwhichinturnmade
themincurredatotalobligationofONEHUNDREDNINETYSIX
THOUSANDFOURHUNDREDEIGHTEENPESOSandEIGHTY

FOURCENTAVOS(PHP196,418.84)asreflectedintheherein
attachedStatementofAccountasofSeptember08,2015,andmarked
asAnnexB.
7) Fromthatdateonwards,CTLCfoundithardtocollectforpayments
fromWINSTONCHARLESMARKETINGinspiteofseveral
demandletterswhichweresenttoandreceivedbythem;
8) However,onOctober27,2015,MS.LUISAV.SAMSONand/or
WINSTONCHARLESMARKETINGtenderedtoCTLCapost
datedSECURITYBANKCHECKdatedOctober27,2015,with
SerialNo.0216702,amountingtoTENTHOUSANDPESOS
(PHP10,000.00),supposedlyrepresentingtheirpaymentfortheir
CashBond.Photocopyofthesaidcheckisheretoattachedand
markedasAnnexC;
9) Consequently,whennegotiated/presentedforpaymenttothedrawee
bank,aforesaidcheckwasreturnedunpaidbytheBankofthe
PhilippineIslands(BPI),MalcolmSquareBranch,withbusiness
addressatUnitedNationsAvenue,Manila,onthespecifieddate
therein,forreasonthatitisDRAWNAGAINSTINSUFFICIENT
FUNDS,asseenintheattachedAnnexDhereof;

PropernotificationsanddemandweremadeandsenttoMr.
HonoratoSamson&Ms.LuisaSamson,thelatterbeingthesignatory
ofthecheck,sothattheyorshecouldreplacethemwithCASHand/or
settlesaidaccountabilitywiththereasonofthereturnthereof.Copyof
thelatestdemandletterisheretoattachedandmarkedasAnnexE
hereof;

Inspiteofthesuccessivedemandlettersentbyourinhouse
counsel,MS.LUISAV.SAMSONand/orWINSTONCHARLES
MARKETING,failedandrefused,andcontinuetofailandrefuseto
redeemincashthefaceamountoftheunfundedreturnedcheck.Filing
ofthiscasewasevensuspendedforalmostseveraltimesalreadyjust
togivethemtheampletimeandopportunitytosettletheirobligations
infull,butthesameservedfutile;

Iamexecutingthisaffidavittoattesttothetruthofthe
foregoingfactsandforthepurposeofchargingMS.LUISAV.
SAMSONasoneoftheOwner/Proprietoroftheirbusiness
