    On3September2015,theMagistratesCourtofVictoriaimposedacriminalpenaltyof
    $330,000againstStenaDrillingAustraliaPtyLtd(Stena)fortheirfailuretoimplementand
    maintainsystemsofworkthatweresafeandwithoutrisktohealthasrequiredunderclause
    9(2)(d)oftheOffshorePetroleumandGreenhouseGasStorageAct2006(OPGGSAct).
    Bywayofprovidingadditionaldetailofthebackgroundto,andcircumstancesthatledtothe
    accident,theSummaryoffactsusedinthecriminalproceedingsagainstStenaDrillingAustralia
    isnowavailableonNOPSEMAswebsite.
    WithreferencetotheSummaryoffacts,NOPSEMAnotes:
    1.Adherencetosafetymanagementsystemrequirementsiscriticaltoensuringthesafetyof
    personnel,includingtheimplementationofkeysafesystemofworkrequirementssuchasrisk
    assessmentandtoolboxtalks.
    2.Asuitableandsufficientriskassessmentshouldbecarriedoutforallstagesoftheworkto
    beundertaken.Workersinvolvedinthetaskshouldhavetheopportunitytocontributetothis
    assessment.Theassessmentshouldincludeaconsiderationoffactorssuchas:
    asufficientlydetailedbreakdownoftaskcomponents
    equipmentselectionanddesignlimitswhereapplicable
    theimpactofexternalconditionsandfactorswhichmayimpactontheabilitytocarryout
    thework
    identificationandevaluationofassociatedrisksandapplicationofcontrolmeasures
    identificationandallocationofindividualrolesandresponsibilities.
    3.Unusualorchangedoperationalcircumstancesandproceduresshouldbesubjecttoarobust
    managementofchangeprocess.
    4.Communicationisacriticalpartofanyworkoffshore.Supervisorsshouldverifythatall
    workersinvolvedinanytaskunderstandtheirroleandanyassociatedrisks.
    5.Allequipmentutilisedinconnectionwithanyworkshouldbefitforpurposeandingood
    workingorder.Iftheequipmentisnotworkingcorrectly,areassessmentoftherisksassociated
    withtheworkortaskshouldbeconducted.
    6.Dutyholdersmustsatisfythemselvesthattherequirementsoftheirsafetymanagement
    systemsarebeingeffectivelyandconsistentlyapplied.
