JOINT MEMO
The Appellant has challenged the Judgment and Decree
dated_____________passed by the ______ Additional City Civil and
Sessions Judge (CCH-18) in O.S. No. ____/2004 on his file in this
appeal.
When the Appeal was heading for final hearing on the advise
by the Court and well wishers of the Appellant and respondents and
their friends to settle the matter amicably between them to keep
good relationship and maintain harmony. Accordingly the matter is
settled on the following terms.
1.

The Appellant shall pay sum of Rs. __________/- as full and final

settlement to the respondents on or before ____________. On receipt

of the payment the respondent shall make an endorsement on the
back of the mortgage deed in the presence of the witnesses and
render assistance to redeem the mortgage at the Officer of the SubRegistrar.
2.

The respondents shall deliver the mortgage deed and the

other linked documents immediately on receipt of the payment to

him at the time of mortgage in favour of Appellant.
3.

The Court Fee paid on the appeal memo shall be return to the

Appellant in the inview of the settlement arrived between the

parties.
