Dear Mr. Bailey:
My research shows that you and your colleagues have represented coal
miners and their survivors and widows on numerous black-lung claims and
deliberate-intention lawsuits against coal companies owned by Jim Justice.
As I'm sure you're aware, Mr. Justice is seeking the Democratic
nomination for Governor of West Virginia.
gather you're a Democrat for your itemized campaign contributions,
which are publicly available at http://www. followthemoney. org for contributions to
state campaigns and at http://www.fec.govifinance/disclosure/norindsea shtml for
contributions to federal campaigns, show that you have been a significant
contributor to a number of Democratic campaigns.
But you also side professionally with coal miners so, although we're
adherents of different parties, | hope we can make common cause.
lam part of the team assembled by the Republican Governors Association
to prevent Mr. Justice from being elected by exposing to the public how unfairly
he has treated his companies’ miners by, for example, deliberately taking
unrepresentative coal-dust samples, engaging in other unsafe practices and
using the unethical Jackson Kelly law firm, a firm that has repeatedly withheld
relevant medical information from black-lung claimants and Department of Labor
Administrative Law Judges (see "Coal industry's go-to law firm withheld evidence
of black lung, at expense of sick miners," Public Integrity, Oct. 29, 2013,
http:/mww.publicintegrity.org/2013/10/29/13585/coal-industrys-go-law-firm-withheld-evidence-black-lung-expense-sick-miners), to defend black-lung claims
filed against his companies.
We are looking for individuals with first-hand knowledge of Justice's
companies’ deceptive and unsafe practices who are willing to go on the record
and tell what they know for films that would be shown on television. I'm writing to
seek your help in identifying such people. The first film crew will be on site
shooting on March 29-31, so time is a factor.
You have clearly stood up for ill coal miners. Helping to deny Jim Justice
the governorship of West Virginia would be another major step in that direction. 1
hope you'll help us.
