Chapter-II General Explanation:

Judge :
According to section 19 of Pakistan penal code, the defilation of a judge is as,
The world JUDGE denotes not only every person who is officially designated as
a judge, but also every person..
Who is empowered by law to give, in any legal proceeding, civil or criminal, a
definitive judgment or judgment which, if not appealed against, would be
definitive, or a judgment which, if confirmed by some other authority, would be
definitive or,
Who is one of body of persons, which body of persons is empowered by law to
give such judgment.
Illustration:
A magistrate exercising jurisdiction in respect of a charge on which he has power
to sentence to fine or imprisonment with or without appeal.
Officer:
The test to determine whether a person is an officer within the meaning of the
section is;
i.
ii.

Whether he is in the service or pay of the government ; and


Whether he is entrusted with performance of any public duty.
An officer of the court whose duty is to execute any judicial process is a public
servant within the meaning of this clause. Executive

officer of by or with

sanctions of state government he being an officer f the administrative service.

Although the word officer as used in common parlance connotes the holder or
incumbent of an officer of an authority, yet the definition has been interpreted
by judicial authority to include all incumbents of offices high or low
irrespective of their status. The word officer is held to include only persons who
have some authority vested in them and would not include persons like mere
clerk, peons etc. who have no authority of their own and merely carrying out
orders.
Officers authorized to prevent commission of an offence.
According to clause (8) of section (21) every officer of the government, whose
duty is, as such officer, to prevent offences, to give information of the offences,
to bring offenders to justice o to protect the public health, safety or
convenience, is a public servant.
Officers competent to protect property etc. on behalf of the government.
Every person according to clause (9) of section (21) whose duty it is, as such
officers, to take, to receive, keep or expend any property on behalf of the
government, or to make any survey, assessment or contract on behalf of the
government or to execute any revenue-process, or to investigate, or to report, or
any matter effecting the pecuniary interest of the government.
