Yankeeland Gold Contract for Open Registration

For Puppies Purchased after February 1, 2016

1) Purpose of this Contract.
If this document accompanies a Yankeeland Gold sales contract, it is indicative that Yankeeland Gold is
permitting a new owner or buyer an open registration which permits a new owner or buyer to register a
litter or litters of puppies as the offspring of the dog named below:

2) Definitions.
For the purposes of this contract, the following definitions apply:
a.

Pet Store means a retail business which sells different kinds of animals to the public.

b.

Commercial Dog Breeder means a person who maintains more than 20 unaltered female dogs
that are at least 12 months old. A commercial dog broker is a person who has a Class B
license under 9 CFR 1.1 and who sells at least 500 dogs per calendar year.

c.

Broker means someone who buys puppies, either individually or entire litters, and then resells
them at a marked up price. For example, a broker might buy a puppy from a small town
newspaper for $50, and then resells it through their website for $350.

d.

Puppy mill means an establishment that breeds puppies for sale, typically on an intensive basis
and in conditions regarded as inhumane.

3) What is intended by Granting of Open Registration.

By granting Open Registration to a new owner or buyer, Yankeeland Gold is granting only the ability to
register a litter or litters of puppies with the American Kennel Club. Yankeeland Gold offers NO
WARRANTY OR GUARANTEE that the above-named dog will successful be bred (ever) or will produce
live puppies (ever). The new owner or buyer assumes all risk associated with breeding and birth, including
but not limited to: injuries to the dog or puppies associated with breeding and birth; color, weight, health of,
and number of puppies born; satisfaction of future owners of the puppies; congenital problems found in the
puppies; and costs and difficulties associated with puppy rearing and placement.
4) Right of Repossesion
If Yankeeland Gold discovers, with a reasonable suspicion, that a Yankeeland Gold puppy has been
purchased by or gifted to a pet store, commercial dog breeder, broker, or puppy mill which has not
disclosed its status or has purchased via a third party strawman, Yankeeland Gold reserves the right to
repossess the sold puppy or gifted puppy.
5) Yankleeland Gold Sales Warranty.
Yankeeland Gold does NOT sell to pet stores, commercial dog breeders, brokers, or puppy mills. Under
Yankeeland Golds general sales contract, breeding any Yankeeland Gold puppy will void Yankeeland
Golds thirty (30) day warranty and one (1) year warranty. However, with the grant of Open Registration,
Yankeeland Gold agrees to adhere to these warranties as described in the sales contract for the above named
dog.
6) Indemnification Clause
The new owner or buyer shall defend, indemnify, and hold Yankeeland Gold, dba Penny Shrock, her
officers, employees, and agents harmless from any and all claims, injuries, damages, losses, or suits
including attorney fees, arising either directly or indirectly from any act or failure to act by Yankeeland

Gold, dba Penny Shrock, or any of her officers or employees, which may occur during or which may arise
out of the performance of this agreement.
7) Additional Terms.
The new owner or buyer stipulates that Yankeeland Gold has the right of repossession of any puppy or dog
which is the subject of this contract, if the new owner or buyer does not fulfill the terms of this Section.

8) Severance.
It is the intent of the parties that if any clause in this contract is void, the remaining agreements should
remain in full force and effect.
I have read the Yankeeland Golds Contract for Open Registration and understand the duties, limitations, and
conditions outlined above. I voluntarily enter into this agreement.
