Advisory to the Court in Holiday v. Stephens; 4:11-cv-01696

Judge Lake:
I write in response to the letter Mr. Holiday filed earlier today at Doc. No. 31.
Mr. Volberding and I continue to represent Mr. Holiday. To wit, on August 14, I
travelled to Madison County to represent Mr. Holiday at the hearing at which his death
warrant was signed.
I have also interviewed at least one potential witness that might have predicated a
successor writ in state court. Although this was ultimately not sufficient to file such a
writ, I warrant to the Court that neither Mr. Volberding nor I have abandoned Mr.
Holiday. Maples v. Thomas, 132 S.Ct. 912 (2012).
I have spoken to Mr. Holidays family members on several occasions in the past
few weeks, as well as other lawyers who call Mr. Volberding and I with
recommendations as the scheduled execution date draws near.
