Be it Enacted by the Senate and House of Representatives in General Court convened: 1 Committee Established. There is established a committee to study the feasibility of licensing residential building and remodeling contractors. 2 Membership and Compensation. 1, The members of the committee shall be as follows: (a) Three members of the house of representatives, appointed by the speaker of the house of representatives. (b) Throe members of the senate, appointed by the president of the senate, II, Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee 3 Duties. ‘The committee shall study the feasibility of licensing residential building and remodeling contractors. The committee's study shall include similar licensing programs in other states, the “contract for construction” concept, continuing education requirements; and the concept of a state-wide building code for site-built construction. 4 Chairperson; Quorum. The members of the study committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 45 days of the effective date of this, section. Four members of the committee shall constitute a quorum. 5 Report. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before Novembér 1, 2005. 6 Effective Date. This act shall take effect upon its passage. The subcommittee has adopted amendments to each of these bills that will be voted on by the full committee March 22, 23 or 24. Both amendments replace the text of the bill entirely. HB 177, relative to home improvement contracts Requires home improvement contractors to have a home improvement contract before working on: = residential property (single-family dwelling or owner-occupied dwelling ‘of not more than 4 units) = fora total contract amount of $5,000 or more Establishes contract requirements such as: * contact information for the contractor reasonably detailed description of the work to be done ‘* ifthe description does not include the specifications for the project, a statement that the specifications will be provided before the commencement of work; specifications must have signed approval of consumer * estimated date of commencement and completion of work (dates may be changed due to circumstances beyond the control of the contractor, such as lack of readiness of job site, unavailability of building materials, weather conditions) = the price of the contract amount of the initial down payment, which shall be limited to limited to no more than 1/3 of the total contract price ‘stipulation that any change order must be in writing and signed by both parties = statement of liability insurance held by contractor HOUSE COMMITTEE RESEARCH Allows the consumer to waive the contract requirements under exigent circumstances ~ severe damage that requires immediate repair in order to mitigate further damage or make the residence habitable Establishes that violations of the Consumer Protection Act under this act shall be brought by the Attorney General only; consumers may sue under contract law HB 469, regulating disputes between homeowners and contractors relative to residential construction defects Goal: encourage out-of-court resolution of disputes between homeowners and contractors when there is a claim of a construction defect Establishes framework for action when a defect is claimed by the homeowner: 60 days prior to any legal action, homeowner sends notice of defect to contractor Within 30 days after receipt of claim, contractor provides written response Response may offer to settle through payment, propose inspection, reject complaint + Ifcontractor requests opportunity to inspect property, homeowner may allow inspection (not required) = Within 15 days of inspection, contractor must disclose result of inspection and propose course of action HB 307, establishing a committee to study the feasibility of licensing residential building and remodeling contractors Committee charged with studying the feasibility of licensing residential building and remodeling contractors, including similar licensing programs in other states, the “contract for construction” concept, continuing education requirements, and the concept of a state- wide building code for site-built construction ‘SB 198, relative to regulating home contractors. The Home Builders & Remodelers Association of New Hampshire (HBRANR), which represents nearly 1,100 firms employing over 60,000 professionals in New Hampshire who are charged with the responsibility of providing balanced housing and quality construction services to all citizens wishes to voice its support for HB 307-AN ACT establishing a committee to study the feasibility of licensing residential building and remodeling contractors, Asan industry facing a great deal of demand for our product, we realize that, of the over 8,000 new home starts in NH and tens of thousands of remodeling projects completed annually, it only takes a few projects handled poorly to adversely impact the image of the industry. The vast majority of building professionals in New Hampshire enjoy excellent reputations for providing quality homes and construction services. The professionals in our association are committed to developing credible solutions to deal with those few individuals and businesses that are providing substandard products and services to the buying public. To address these concerns our association began taking a series of proactive steps a year ago to work towards solutions that will, hopefully, result in increasing professionalism in the industry, increased quality assurances in construction projects, and better relationships between consumers and builders. We first of all began by promoting and offering continuing education for professionals in the construction industry through our licensing agreement with the University of Housing, the education arm of the National Association of Home Builders (NAHB), located in Washington, DC. oR oe iy BUBESK e REMODEL RS ASSOuNTES og oS February 3, 2005 To: Members of the House Executive Departments & Admin. Page 2. ‘The extensive curriculum for this program includes courses that cover such topics as financial management, business management, customer service, project management, codes & standards, construction contracts & law, sales and marketing, and estimating, to name just a few. ‘These in-depth courses lead graduates, who must pass rigorous tests, to eam professional designations such as Certified Graduate Remodeler (CGR), Certified Graduate Builder (CGB), and Certified Master Builder. ‘We are certain that this nationally accepted standard can form a basis for the testing, training, and continued training of the professional builder or remodeler in New Hampshire that can only lift the quality of the products and services being provided to our consumers, We know, because many of ‘our members are already aspiring to these heights. The next element that we identified in our effort to improve the industry was the need for a “contract statute” that spells out minimum requirements that must be in the written contract between the builder and the consumer. We are pleased that this missing item was also identified by Representative Lee Slocum who introduced HB 177 during this session and we have been working closely with the House Commerce Subcommittee, as recently as yesterday, and fully expect a positive outcome from that effort. The final, and some respects most crucial, aspect concerning this issue that we are strongly recommending is the adoption of a state-wide residential building code for site built work. Many people are unaware that New Hampshire does not have this minimum structural code in place to provide uniformity across all jurisdictions. Builders and remodelers must determine what code, if any, is enforced in each town where business is conducted. Indeed, some towns have no codes in place at all or, at best, follow outdated codes. With education as the basis of our strategy to improve the industry our current step was the filing, by Representative Infantine, of HB 307, which we are discussing today. In studying the issue with a goal of developing a program that works for New Hampshire it will be ‘most important to determine what other states have done relative to the issue of builder licensing. Equally as important will be to meet with consumers who have experienced poor relations with builders, reccived substandard quality products and services, and in some cases suffered financial loss. We have begun this process and recommend that it be continued in depth with the goal of identifying the major themes that run throughout their collective experiences to, hopefully, identify workable solutions. As of September, 2004, it would appear that 23 states had some type of licensing or registration that covered various professions that do contracting work. Of those 23, some programs are simply registration programs that, in our view, do not provide solutions that we are looking for. Ofnnote, in those states that appear to have licensing programs that we recommend studying, several have incorporated continuing educational requirements in order to renew the license or certificate, As stated, we endorse this element of a potential licensing program and would move to have it included in the discussions of the study committee, We wish to make the committee aware of a bill in the New Hampshire Senate, SB 198-FN, that calls for the “registration and regulation of home contractors”. This bill, which is scheduled to come before the Senate’s Public and Municipal Affairs Committee on February 16" does not include all the necessary elements that we are discussing here today that would, in our view, provide the opportunity for solutions to the issues at hand. Having been made aware late last year through media reports of the sponsor’ intentions to bring forward SB-198 we held two meetings with the Senator to share our views and offer to work together to craft the sought after solution to the issues. We would request a decision by this committee in a timely manner to approve setting up the study committee, as requested in HB 307, so that we can carry your message to the Senate hearing in two weeks. In summary, the Home Builders & Remodelers Association of New Hampshire recommends moving forward in a thoughtful and thorough manner to see if we can come up with credible and workable solutions that will help alleviate the problems. The program that we envision will include, ata minimum, the following critical elements. Contractors Board Continuing Education Requirements Administration Fee Structure Licensing Requirements Permitting Processes and Inspections Educational Requirements Reciprocity Across State Lines Testing Requirements Renewal Provisions Grandfathering Disciplinary Proceedings ‘We are certain that any law enacted that does not include these elements will fail to provide solutions for consumers nor be acceptable to the hard working professionals in our industry. We respectfully ask for your support to develop credible solutions that will work to solve the issues at hand and we look forward to working with you. I did so because my daughter and son-in-law were defrauded of $12,000 by an unscrupulous practitioner of that honorable trade, ‘This Session, four bills dealing with the issue of bad contractors have been filed. One of the bills has been referred to the House ED&A Committee: HB 307, establishing a committee to study the feasibility of licensing residential building and remodeling contractors, sponsored by Rep. William Infantine. The hearing is scheduled for February 3 at Feb 11:00 am. Please give this bill your closest attention. Attached is a List of 36 persons who I have personally spoken with; 34 have been bumed by contractors. I have listened to their stories of heartbreak and victimization. All have agreed to allow me to distribute their names. Please, as you read my List, note the amounts of money stolen. All 36 persons agree that the time for licensure is NOW; that too many people, too frequently, have been financially and emotionally bumed; that the system needs fixing. ‘Overall, I have spoken with more than 60 persons. Unfortunately, not all agreed to:appear on my List. As a result I took this as a rejection of our attempts to resolve this concem on our own, and I saw no reason to follow up with you for a payment plan as we had discussed on the phone on 9 March. I never heard back from you as well on this matter. Today, | talked to the small claims office again about the payment plan that we had been working on. I was told that it would be advantageous to both of us to present a plan at the hearing. It would show good faith on your part, and would cut down on the amount of time in court for both of us.
