Welcome to our ranch!

Were so glad you can join us, and we want everyone to enjoy themselves and
have a great time. This does come with a necessary caution, however. Please know this is a real ranch,
the animals can be dangerous, the terrain is rugged and authentic Texas back country, so we ask that
you be mindful and take reasonable caution--be careful in whatever activities you choose to do. In
order to keep our insurance broker happy, we request that you sign the agreement below.

WAIVER AND RELEASE AGREEMENT

Please read carefully before signing. This is a release of liability and a waiver of certain legal rights.
In consideration for my being permitted to participate in the activities of The Amelio Ranch, I agree to
the following Waiver and Release:
I acknowledge that there are inherent risks, hazards, and dangers for anyone who is participating in the
following activities and that these risks, hazards, and dangers cannot be eliminated:
1. Animals both wild and domestic that may be diseased and/or potentially dangerous;
2. Poisonous snakes, insects and spiders;
3. Farm Buildings, lodging, pool, recreational areas and other facilities and structures that are
neither engineered nor constructed to any code(s);
4. Farm equipment that may not have all safety equipment fully operational;
5. Erosion and general condition of the land, both on and off roadways or trails, creating rough,
hazardous and dangerous driving, riding and walking conditions;
6. Deep water, streams, ponds, docks and swinging bridges;
7. Swimming pools and hot tubs that are not safe for diving, slippery surfaces and rough
landscaping;
8. A person with firearms or fishing equipment;
9. The use of farm equipment, vehicles or recreational vehicles, including off-road vehicles,
bicycles, horse-drawn apparatuses and boats being operated by myself as well as others.
10. Water hazards (including drowning) inherent in tubing, floating, swimming, and participating in
any and all water activities;
11. Hiking in the area of The Ranch;
12. Injuries from equipment and other participants;
13. Encounters with wildlife, animals, and insects;
14. Temperature extremes;
15. Inclement weather conditions;
16. Unavailability of immediate medical attention due to our rural location;
17. Hayrides;
18. Heavy rains causing rapidly rising waters and flooding;
19. Horseback riding

I understand the risks, hazards, and dangers of the above activities (the Activities). My participation in
these Activities is purely voluntary. No one is forcing me to participate and I elect to participate in spite
of any risks. I am voluntarily using the services of The Amelio Ranch with full knowledge of the inherent
risks, hazards, and dangers involved and hereby assume and accept any and all risks of injury, paralysis,
or death.
Mindful of all the risks outlined in the preamble above, the undersigned warrants and agrees with the
Owners of the Amelio Ranch (the Owners) as follows:
1. I am in good physical condition and am able to participate in the Activities. I will participate in the
Activities at my own pace and at my own risk. In the event I permit any of my minor children to
participate in any of the Activities, I agree that such participation is at my sole risk and does not
impose any liability on the Owners.
2. I understand that participation in the Activities is not encouraged by the Owners and does not
constitute an activity incident to or within the scope of any employment or other legal relationship I
have with the Owners.
3. I understand that in participating in the Activities there is a possibility of accidental or other physical
injury or of loss of, or damage to, personal property. I agree to assume all risk of such injury to me
or any of my minor children or loss of, or damage to, property and further agree to indemnify and
hold harmless the Owners, and their employees, personnel or agents, from any liability, loss, cost,
damage, expense (including attorneys fees), claim or suit whatsoever for any and all injury, loss,
illness, harm, cost, expense, claim, suit, or damage resulting from, or related to, the participation by
me or any of my minor children in any of the activities.
4. This Release and Waiver shall be governed by and construed in accordance with the laws of the
State of Texas and I consent to the exclusive jurisdiction of the courts of the State of Texas with
respect to any disputes or claims arising hereunder.
5. This Release and Waiver sets forth my entire understanding as to the subject matter hereof.
6. The preamble set forth above is incorporated into this Release and Waiver.
