cause exists for warrantless arrest of the person named below, and that the
following facts are true and correct to the best of my knowledge,
information, and belief, and support the arrest of the defendant.

1. On Wednesday, February 24, 2010 at about 21:18 officers of the Grand
Junction Police Department were sent to the address of 1600 North Ave. room 141
where Dustin Vogt (dob 8-16-83) was reporting he was stabbed by an unknown male
who fled on foot. Off. Langevin reported he found Vogt in his room laying on
his bed bleeding heavily from a wound to his stomach. Vogt told Off. Langevin
the assailant confronted him near room 141 about throwing a bottle at the door
to the hotel room. Vogt said the male then stabbed him and ran. Vogt claimed
this was the first time he saw the suspect and didn't know him. Vogt described
the suspect as a white male in his twenties, shorter build, with short brown
hair, clean shaven, possible light mustache, wearing an unknown color tee shirt
and pants. Officers found a broken beer bottle and blood on the sidewalk in
front of rooms 140 and 141, and also inside room 141.
2. Dustin Vogt was transported to St. Mary's Hospital Emergency Room for
treatment. (@lMMMNNgpsigned a Physician's Report of Serious Bodily Injury
form due to the location and nature of the wound. The wound is described as a
1.5" vertical laceration type injury in the lower left abdomen.
3. Off. Cox spoke with hotel employee who advised
she contacted Vogt earlier in the evening at room 141 for being too loud and
disturbing other tenents. said she later saw Vogt and dustin Vincino
(dob 4-17-80), the guest of room 140 talking together outside their rooms. She
said she has Seen them and their associates together on other occassions.
Off. Cox reported speaking with Justin Vicino,

reported QEMMNMMIP was asleep and didn't wake up.
4, GERRI 00.25 working at the mmergency Veterinarian
Clinic at 1660 North Ave. stated she was in back of her building between 20:30
to 21:00 when she saw two white males standing in front of rooms 140 and 141
yelling at eachother, She stated the shorter male was yelling at the taller
Rale for hitting a girl. She said the taller male was claiming the fenale
actully hit him, pointing out marks on his face from being struck.
Said she went back insige at this point —
5. On Thursday morning, Feb. 25, 2010, I met with Dustin Vogt at St. Mary's
Hospital. I noticed upon seeing him, he had a 1/2" fresh circular mark on his
forearm I believed to be a burn mark. I asked about this. He described
himself as a person who hurts himself, displaying cut scars on both inner
forearms. He stated he burnt himself here last night, Dustin described
himself as being pretty intoxicated last night. Dustin stated he wasn't
truthful with officers last night. He stated he was dating for
about two weeks, saying they spent the night before (Feb. 23/24, 2010) together
in a room at the Monument Inn. He stated he broke up with her after that. He
stated last night, he was staying in Room 141 at the Inn with

came over. He said during the evening, assed out on the bed while he
and the others went next door to room 14) wnich he said was "Jay's" room.
Dustin said he and QB yo: into an argument and went outside. He said
said something to him that made him mad and he tried to slap her in
the face. He said she began punching him in the face with her fists. He said
Jay stepped in between them and told him to go away. He said they yelled back
and forth before day walked back into room 140. He said Jay came back out
moments later and pulled out a folding knife he described as having a 5-6 inch
blade. Dustin stated he (Dustin) threw his arms up in the air and said
something to the effect; If your going to do something, do it! He said Jay
then stabbed him once in the stomach. Dustin stated he backed off and walked
to his room and layed down, calling 911 for help. Dustin who is 6'2", 2051bs,
described Jay as being 5'2", 1501bs, having black very short hair with’ a
goatee.
7, 1 contacted QUINN. che Honunent tan and was told by her dustin
Victno’was the regiatered guest. in Room 110,
8. ‘This same date, I compiled a photo line-up which included Justin Allen
Vicino (dob 4-17-80) with five other similar males. Vicino is described as
5°6", 1501bs, having black very short hair, with a goatee. I met with Dustin
Vogt a second time and showed him the line-up. Dustin immeditaly pointed out
Justin Vicino as the suspect who stabbed him.
9, This same date I located Justin Vicino sitting on a bus bench in the 1800
biock of North Ave. vith /—// snd T contacted Justin
and @MEMEMMPand asked if they would come to the police department for an
interview. They agreed.
10, QE stared she did get into an argument with Dustin outside
Sustin's room last night, stating Dustin did slap her. She stated she slugged
Dustin back. She said Justin stepped in between them and they seperated. She
said she and gustin went back into Justin's room. She said she went for a walk
and saw Dustin laying on his bed bleeding, stating she didn't see him get
