ORDER SETTING SCHEDULING CONFERENCE

AND REQUIRING JOINT STATUS REPORT

This case is set for Scheduling Conference on November 16, 2007 at 12:00 p.m. before U.
S. Magistrate Judge Steven P. Shreder at the U.S. Courthouse, 5th and Okmulgee Streets, Room 425,
Muskogee, Oklahoma.

Pursuant to Fed.R.Civ.P 26(f), the parties are to confer as soon as practicable but not less
than 14 days prior to the Scheduling Conference. The parties are directed to prepare and submit to
the Court a Joint Status Report on or before November 13, 2007. Joint Status Report forms are
available in the Court Clerk’s office, or can be obtained from our public web site at
www.oked.uscourts.gov.

Unless good cause is shown, the Court will enter the following deadlines at the Scheduling
Conference: (i) joinder of additional parties or amendments to the pleadings by November 30, 2007;
(ii) exchange and file witness and exhibit lists by May 30, 2008; (iii) discovery completed by June
30, 2008; (iv) all dispositive motions & motions in limine filed by July 14, 2008; (v) exchange all
trial exhibits including demonstrative exhibits, and requested jury instructions by July 25, 2008; (vi)
submit agreed pretrial order, file agreed jury instructions and proposed voir dire, proposed findings
of fact and conclusions of law (non-jury), disputed jury instructions (included in trial brief) and trial
briefs by August 1, 2008; (vii) pretrial conference August 8, 2008; (viii) trial date August 18, 2008.
