2015 Robotics Camps


Policies, Release, and Acknowledgment
THIS POLICIES, RELEASE, AND ACKNOWLEDGMENT (Release) is entered into by Be
Greater Than Average, LLC (Be Greater Than Average), and
(Adult), with
reference to the following:
RECITALS
WHEREAS Be Greater Than Average is hosting a robotics camp (Camp) to expose
students to the field of science, technology, engineering, and mathematics, or STEM;
WHEREAS students who participate in the Camp shall work in a team environment
learning basic tool skills, writing an engineering manual, giving a marketing presentation, and
participating in a hands-on robotics competition against other students;
WHEREAS the Adult wishes his or her student (Student) to participate in the Camp;
WHEREAS Be Greater Than Average is willing to allow the Student to participate in the
Camp;
WHEREAS Be Greater Than Average has set forth policies (Policies) for the Camp with
which it expects the Adult to understand and agree;
WHEREAS the Adult wishes to understand and agree to the Policies;
WHEREAS the Adult is willing to release and indemnify Be Greater Than Average from any
liability and any and all claims related to the Students participation in the Camp;
NOW, THEREFORE, in consideration of the Recitals hereinabove mentioned and of the
terms, conditions, covenants, and warranties hereinafter mentioned to be kept, honored, and
performed by the parties, it is hereby agreed as follows:
TERMS AND CONDITIONS
1.

Policies. The Adult understands and agrees with the following Policies:
a. Conduct. The Student shall be required to comply with all Camp rules and standards. Be
Greater Than Average reserves the right to terminate the Students participation in the
Camp if, at any time, the Student fails to comply with such rules and/or standards,
particularly if such failure threatens the health or safety of the Student or others, or
jeopardizes the success of the Camp. If so terminated, neither the Student nor Adult shall
be eligible for a Camp refund.
b. Special Concerns. Prior to the Students participation in Camp, the Adult shall identify
and discuss with the Camp director any behavioral problems or special physical,
emotional, psychological, or medical needs, including allergies, of the Student.
c. Medical Treatment.

Camp staff shall not administer any medication to the Student.

In the event of an emergency in which Camp staff is unable to contact the Adult,
Camp staff may take appropriate action which may include arranging
transportation of the Student to an appropriate medical care facility. If the
Student requires medical care, the Adult gives his or her consent to any licensed
physician to whom the Student is taken for medical care, to administer drugs
and medication, and to perform such treatment as the physician finds necessary
for the Student for pain relief and/or preservation of the Students life and/or
health and well-being. Costs incurred for treatment of the Student for such
emergency shall not be the responsibility of Be Greater Than Average.

d. Photographs. The Adult shall permit Be Greater Than Average to use pictures of the
Student, as a Camp participant, in promotional literature published and used by Be
Greater Than Average, including, but not limited to, newsletters, brochures, and the Be
Greater Than Average website.
e. Lost Items. Be Greater Than Average shall not be responsible for any personal items of
the Student lost or stolen during the Camp. Be Greater Than Average recommends that
the Students name be written on his or her personal items.

Release. The Adult hereby releases, acquits, and forever discharges Be Greater Than
Average and its agents, officers, directors, members, employees, Camp staff, and its
successors and assigns, of and from any and all claims, liabilities, demands, complaints,
causes of action, costs, expenses, attorneys fees, damages, indemnities, and obligations
of every kind and nature, in law or in equity, fixed or contingent, known and unknown,
suspected and unsuspected, disclosed and undisclosed, arising out of or relating to the
Students participation in the Camp.

1Indemnification. To the fullest extent permitted by law, the Adult shall indemnify and
hold harmless Be Greater Than Average, its officers, directors, present or former
employees, Camp staff, and agents, from and against claims, damages, losses, and
expenses, including but not limited to attorneys fees, brought by third parties arising out
of or resulting from the Students participation in the Camp.

Severability. In the event that any provision in this Release shall be held invalid or
unenforceable by a court of competent jurisdiction, such holding shall not invalidate or
render unenforceable any other provision of this Release.

5.

Forum. This Release shall be governed by and construed in accordance with the laws of
the State of New Mexico.

6.

Modification. This Release constitutes the final and entire expression of the parties to
this Release, and there is no agreement or promise on the part of the parties to do or omit
to do any act or thing not herein mentioned. This Release may not be effectively
amended, changed, modified, or altered without the written consent of both parties.

7.

Binding Provisions. The provisions of this Release shall be binding on the heirs,
personal representatives, successors, and assigns of the parties to this Release.

By signing below, I acknowledge that I have read this Policies, Release, and
Acknowledgment and understand all its terms.
I execute this Policies, Release, and
Acknowledgment voluntarily and with full knowledge of its significance.
