Defendant
Defendant appears on a charge of public intoxication. The court advised the defendant of the nature
of the charge and the maximum range of penalty. The court advised the defendant that he could
plead not guilty, in which event the matter would be set for trial. The court advised the defendant that
alternatively, if he were to plead guilty, the court would sentence him to serve a term of 15 days in
the Sac County jail with all but time served suspended for a period of one year during the defendant's
good behavior. In this situation good behavior shall include no use of alcohol or illegal drugs and
obeying all laws of the state of Iowa and the United States. The defendant then chose to enter a guilty
plea understanding that this would be the sentence the court will impose. Based on that guilty plea
the court sentences the defendant as follows:
He is sentenced to serve a term of 15 days in the Sac County jail with all but time served suspended
for a period of one year during the defendant's good behavior. In this situation good behavior shall
include no use of alcohol or illegal drugs and obeying all laws of the state of Iowa and the United
States during such one year period. In the event that he does not follow the terms of release a
warrant shall issue for his arrest, a hearing shall be held on whether he has failed to fulfill the terms of
release, and an order shall be issued accordingly.
