Assignment: What was the process through which India acquired a constitution?
Can we say that the Indian constitution truly represents the Indian society?
What is a constitution, and does it evolve?
A constitution literally, is a set of rules and regulations that guide social
cohesion. Every constitution stands on the bedroom of legality or legal frame
work, which ensures social contract among people and government of that given
society. It is therefore, necessary to note that within this frame every individual
or groups that compose of the society must be guaranteed rights, privileges and
access to all public space, which is inclusive of government facilities, like
infrastructure, education, health etc. The duty of the constitution is to guarantee
of formal legal bounding, endorse by the entirety of the people, this does not
necessary mean that people of the entire country will draft the constitution to
govern themselves.
How does it evolve?
Every constitution in the world has a process of evolving. In human history this
process started from the appearance of state, after the disintegration of the
primitive accumulation system. State becomes the arbiter or distributor of rule
and regulation to ensure social existence. In modern terms due to the advent of
capitalism, the notion of constitution had changed drastically, which in a sense
now involves decolonialization process in formal colonies. There is a clear
distinction here, before the invasion of imperialist on the Indian subcontinent
constitution existed, during monarchy and princely rule of various communities.
My argument here is that constitution became a legal document white paper
and written, initially it was unwritten.
