orpinance:¢, -2008 AN ORDINANCE TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACTS WITH CLECO CORPORTION AND TO EXECUTE A POWER SUPPLY AGREEMENT WITH CLECO CORPORATION; TO EXECUTE ALL ANCILLARY CONTRACTS AND DOCUMENTS NECESSARY TO IMPLEMENT THE COUNCIL APPROVED MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY AND CLECO CORPORATION IN FURTHERANCE OF THE COMPLETE SETTLEMENT OF ALL CLAIMS AND DISPUTES IN THE LITIGATION STYLED “CITY OF ALEXANDRIA VS. CLECO CORPORATION, ET AL.,” DOCKET NO. 05-1121-A ON THE DOCKET OF THE UNITED STATES DISTRICT COURT, WESTERN DISTRICT OF LOUISIANA, ALEXANDRIA DIVISION AND TO PROVIDE FOR RELATED MATTERS. BE IT ORDAINED by the Council of the City of Alexandria, Louisiana: SECTION I. BE IT ORDAINED by the Council of the City of Alexandria, Louisiana, in legal session convened, that the City Council authorizes the Mayor on behalf of the City of Alexandria to enter into a Power Supply Agreement with Cleco Corporation under terms and conditions as the Mayor, in his discretion, deems necessary and proper. SECTION II. BE IT FURTHER ORDAINED that the City Council authorizes the Mayor on behalf of the City of Alexandria to also enter such other ancillary contracts and execute such other documents necessary in his opinion to implement the Council approved Memorandum of Understanding between the City of Alexandria and Cleco Corporation in furtherance of the complete settlement of all claims and disputes in the litigation styled “City of Alexandria vs. Cleco Corporation, et al.,” Docket No. 05-1121-A on the docket of the United States District Court, Western District of Louisiana, Alexandria Division. SECTION III. BE IT FURTHER ORDAINED this Ordinance shall become effective upon signature by the Mayor, or, if not signed or vetoed by the Mayor, upon expiration of the time for ordinances to become law without the signature by the Mayor.
