No averments of the OA shall be treated to be admitied unless so specifically admitted in the present reply. Preliminary Submission 1. That the applicant has prayed following relief in the original application:- 8.1 This Hon'ble Tribunal may kindly be pleased to direct, the respondents to grant Group-B Guzetted status to the members of the applicant No.i association in the interest of justice 8.2 This Hon'ble Tribunai may futher be pleased to hold the action on the part of respondents as per se illegal, arbitrary and bad in the eyes of law. 8.2 This Hon'ble Tribunal may further be pleased to award the cost of instant lis in favour of the applicant 8.4 Any other reliefis}, direction(s), instruction{s} which the Hon'ble Tribunal deems fit and proper looking to the above facts and circumstances of the case be also awarded in favour of applicant in the best interest of justice. gt e oe ws xian Dy Chiat Personas! Omese 5. tata (6.1) & ‘The brief facts of the case is as under:- (i) That, the Applicant Association viz. South East Central Railway Engineers Association is not a recognized trade union / association representing Technical Supervisors ( viz. Junior Engineers, Section Engineers, Sr. Section Engineers etc.) in Signal & Telecom, Civil, Mechanical and Electrical Engg. Departments and Loco sheds, Diesel Sheds Electric Sheds Workshops in South East Central Railway, The Applicant Association have prayed that their constituent members ( viz. Ur. Engineers and Sr. Section Engineers) which are Group ‘C’ staff working in pay structure PB 2 GP Rs. 4200 and 4600 should be declared as Group 'B’ staff en- mass ignoring the prescribed selection procedures for appointment to Group ‘B’ posts. (i) That, the members of this association, presently designated as Jr. Engineers and Sr. Section Engincers etc. have been classified as Group ‘C right from 1* Pay Commission era. Thus there is no fresh cause of grievance. (iii) ‘That, the Indian Railways is a multi-disciplinary operational system involving safety considerations in operation of trains and human factor is a vital factor in above operations. Service conditions of the staff are therefore, required to be governed keoping in view functional, operational and administrative requirements of the organization to ensure safe, effective and efficient functioning of the system. Accordingly, Railway employees are governed by separate set of rules as adopted / notified by the Ministry of Railways based on administrative / functional / operational requirement of Railways. (iv) That, the Rule 103/43) of Indian Railway Establishment Code Vol.-I {notified under article 309 of constitution) defines Railway servants ay “Railway Servant means a person who is a member of service or holds a post under the administrative control of Railway Board. It also includes a person who is holding the post of Chairman, Financial Commissioner or a Member of the Railway Board. Persons lent from a service or post which is not under the administrative control of the Railway Board to a service or post which in under such administrative control do not come within the scope of this definition. The members of applicant Association in the instant ©.A. are Railway Servants holding Railway service post. (x) ‘That, the Railway Scrvants are governed by the Railway Services (Revised Pay} Rules, 2008, Railway Services (Condtict) Rules, 1966; Railway Services (Discipline and Appeal) Rules,1968, the provisions of Indian Railway Oe Aer? coe win stent Establishment Code and various other Rules as notified / adopted by the Ministry of Railways (Railway Board) (vi) That, on the other hand, the posts of staff employed under various Ministries of government of India (other than Railways) are classified as Central Civil Service posts and are governed by Central Civil Services ( Revised Pay) Rules, 2008, Central Civil Services (Classification, Control and Appeal) Rules, 1965 and various other Rules governing central civil services under above Ministries of Goverment of India Above rules are not applicable to Railway Service posts / Railway Servants. (vii) That, the DOP&T issues orders from time to time regarding classification of various Central Civil Service posts under the provisions of CCS (CCA) Rules, 1965. Accordingly, DOP&T had issued orders dated 9 April, 2009 Annexure R/1 on the issue of revised classification of “Central Civil posts” after implementation of 6% CPC pay structure. (iti) ‘That, the classification as contained in DOPT’s above orders 9th April, 2009 has been carried out under Rule 6 of CCS (CCA) Rules, 1965. The extract of Rule 6 of CCS (CCA) Rules, 1965 Annexure R/2. The same has been incorporated in supersession of earlier classification of Central Civil Posts issued vide NOP&T's notification dt. 20.04.1998 Annexure R/S after implementation of 5% CPC pay structure. In the explanation under above Notification dt, 9.4,2009, it has been clarified that for the purpose of above order Pay Band in relation to a post means the running Pay Bands specified in the First Schedule to the Central Civil Services (revised Pay) Rules, 2008.The extract Oe Oy Chiat Person! (ix) That, the Railway service posts are specifically excluded from the purview of CCS (CCA) Rules, 1965 vide Rule 3/1) of these rules. Similarly, Rule 2 of CCS (RP) Rules, 2008 read with Memorandum explanatory to above rules excludes Railway employees from the purview of above rules. Since, CCS (CCA) Rules, 1965 and Central Civil Services (Revised Pay) Rules, 2008 are not applicable to Railway Servants, above classification notified by DOP&T vide orders dt. 09.04.2009 | or earlier orders dated 20,4,1998 etc.) does not apply to posts of Railway services, which are governed by separate set of Rules knewn as RS(D&A)Rules, 1968 and Railway Services (Revised Pay) Rules, 2008. (x) That, the revised pay structure as per the recommendations of 6% CPC, has been implemented on the Railways vide Railway Services (Revised Pay) Rules, 2008 notified vide GSR 643(E) dt. 4.09.2008.and it was stipulated in Footnote (iii) of First Schedule Part A Section I that:- "The existing classification of Railway servants in group 'D’, °C’, 'B’ & ‘A’ on the basis of the existing scales of pay will continue in the revised pay structure till further orders except as may be specifically prescribed otherwise by Ministry of Railways (Railway Board). No change in the classification should be made in the revised soules.” (xi) ‘That, the Classification of Railway Service posts is governed by Rule 107 of Indian Railway Establishment Code Vol. I (Fifth edition -1985), Revised classification of Railway Service posts, after implementation of 6% €PC pay structure, has been reviewed keeping in view their administralive, functional and operational requirements, aye” Sug wie oftort Dy. Ghiet Personal Officer __ Ht Reo (2) horizontal and vertical relativities as well as relevant background and accordingly notified vide Board’s letter No. PC VI/2009/RSRP/4 dated 08/01/2010. Accordingly, relevant para of Indian Kailway Establishment Code Vol I has also been modified through ACS No 110/2010 and also circulated vide Estt. Rule No. 11/2010 Annexure R/S. (xii) ‘That, as per above orders dated 08.01.2010 /amended Rule 107 of Indian Railway Establishment Code Vol, various posts in revised pay structure of Pay Band PB-2 with Grade Pay Rs.1800, 1900, 2000, 2400, 2800, 4200 and 4600 have been retained in existing classification of Group ‘C’, apart from certain other specific categories which though placed in higher GP have been specifically classified as Group ‘C’ and retained as such in 6 CPC pay mn structure also. Accordingly, Jr. Engineers, Se Engineers / Sr. Scction Engineers ete. in above pay structure of PB-2 GP Rs.4200 and 4600 have also been continued in their existing classification of Group ‘C (xiii) That, it is relevant to mention here that in the other Ministries Group ‘B’ posts arc gazetted as well as non gazetted, The Group ‘B’ posts on the Zonal Railways (field organizations. under Ministry of Railways), which are operational systems, are exclusively Gazetted posts. Keeping in view the functional requirements of above posts classified as Group ‘B(Gaz.), there are much stringent norms / procedure for appointment to such posts. On the ether hand , norms / standards for appointment to Group ‘C’ posts are much lower. fxiv) That, at present Group ‘B? constitutes managerial level, exercising control over staff in lower grades. If the classification norms as followed in other Ministries are qn wet att Dy Chiat Person Olea adopted on the Railways, it would lead to drastic upheavals in the hierarchical structure. Group ‘B' Gaz. Officers of Railways have been entrusted various disciplinary powers. Such powers are neither available 1ior justifiable for the staff in GP Rs.4200/- and Rs.4600/- presently classified as Group (xe) That, there are hundreds of categories of staff in various departments of Railways in Grade Pay Rs.4200/- and 4600/- involving lakhs of employees. Group ‘C’ employees in GP Ris.4600, It is worthwhile to mention here that reclassification of posts in GP Rs.4200 and 4600 as Group 'B' would give rise to numerous administrative, functional and operational problems / difficulties. 2s tet Aare (on) (xvi) Thar, the Railways follows a system of distribution of Group ‘C’ posts on percentage basis which is unique on the Railways. Under above system, Group ‘C’ posts: in higher scales / grade puy ever kecp increasing. A comparison of such pests with posts in other Ministries which are not on percentage basis and whose functional and operational characteristics are completely different from that prevalent on the Railways would be misleading. (xvii) ‘That, there is an administrative linkage between the number of posts in Group ‘B’ and Group ‘A’. The Group ‘B’ posts act as stepping stone to Group ‘A’ services for promotec officers. Increase in the number of Group ‘B’ posts would necessitate creation of additional Group ‘A’ posts. By merely classifying Group °C’ posts as Group ‘B” based on the scale of pay or criteria adopted by other organizations would completely upsct this equilibrium between Group ‘B’ and Group ‘A’ and there will be administrative chaos. (xviii) That, the selection for filling up of Group ‘B’ posts in Railways is done based on the prescribed statutory rules and other instructions issued by the Railway Board. It is the entry point to the Gazetted Cadre, Such Group ‘B’ officers are eligible for induction into respective Group ‘A’ organized Railway service on the recommendation of the Union Public Service Commission apart from those appointed as direct recruits through © Combined Engineering Services Examination/combined Civil Services Examination. The vacancies in Group ‘B’ posts in departments having organized services of Railways are filled in the following manners:- fa) Selection (70% }: From amongst the eligible and willing staff, coming within the zone of consideration, in re of PB2 GP Rs.4200/ and above and revised pay struct be who have completed three years of non-fortuitous service in such grade : and (b) LDCE (30% |: From among the volunteers from staff in revised pay structure PB2 GP Rs 4200 and above and who have put in five years non-fortuitous service in stich grade. w In Selection (70%) seniority plays a vital role. The selection consists of written test to adjudge the professional ability followed by viva-voce and assessment of record of service by selection committee. Staff securing at least 90 out of 150 marks in the written test is eligible to be considered for viva-voce. Viva voce and assessment of record of service each carries 25 marks. To be considered for empanelment, an employee should secure at least 90 marks out of 150 in the written test and 30 marks in the record of service and viva voce put together subject to a minimum of 15 marks in the record of service, (i) The methods of selection for 70% (Selection) and 30% (LDCE) are different. In the former, the panel is formed in order of seniority in the latter it is formed based on merit only. (im Presently, Group ‘B’ entry scale in various Departments of Railways happens to be Grade Pay Rs, 4800 (except in the Accounts Department, where the entry pay structure is PB2 GP Rs.5400), Appointments to Group ‘B’ posts on the Railways are made in accordance with the selection procedure which has been evolved over the years. Prior to such appointment, while the professional ability is tested through a written examination and employees who qualify in the viva-voce and get qualifying marks in assessment of record of service are alone empanelled. (xix) ‘That, the procedure which is being followed in the other Central Government Departments is not of any relevance for Railways, as each department is free to evolve its own procedure for promotion etc... to suit the requirements of the organization. Appointment to Group ‘B’ posts on Railways involves a much rigorous selection procedure than in other departments. The Railways cannot be expected to blindly follow the path followed by ‘Inclusive’ Organization. oe) That, the Classification of posts in Railways is decided keeping in view a number of factors such as duties and responsibilities of the post, position in the administrative set up/ hierarchy, its reporting channels, the recruitment and selection criteria, the discipline and appeal rule/responsibilities and various other functional, operational and administrative considerations eve (xxi) That, the reclassification of all the posts in GP Rs.4200 and 4600 as requested in the OA will give rise to demands for stenographic assistance, pass entitlements etc. commensurate with Group ‘B’ Railway Classification which may not even be available to staff of various other Ministries / organizations governed by DOPT’s orders dated 20.04.1998 and 09.04.2009. This will result in operational costs of the Railways without functional or organizational needs. (xxi) That, the instructions issued by Ministry of Home Affairs or now DOP&T do net have much relevance to the classification of Railway service posts which is done by Ministry of Railways Keeping in view their administrative, operational and functional requirements.
