Reaffirmations While the discharge of debts owed by the debtor of any legal obligation to pay those debts, the debtor may agree to reaffirm or reassume the debts after bankcruptcy proceeding. However, since the debtor may be under a great deal of pressure from former creditors to reaffirm the discharged debts, the bankruptcy laws make the reaffirmation of debts somewhat difficult. A simple promise by the debtor, even in writing, is not sufficient for a valid reaffirmation. First the court must conduct a hearing at which the debtor is informed of the consequences of such action. Second. The debt must usually be approved by the court as not imposing an undue hardship on the debtor and being in the debtors best interest. If these conditions are not met, the reaffirmation of the debts is not valid and its discharge is effective.

Business Reorganization Instead of filing a petition for liquidation, an individual or business may elect to file for reorganization under chapter 11 of the bankcruptcy act. As in liqudation proceeding a petition for reorganization may also be filed b the creditors. Most of the rules that aplly to the liquidation proceeding also apply to the reorganization. Railroads ,however are not liquidation because of the publics dependence on their services. Reorganization allows a financially troubled firm or railroad to continue to operate while its financial resoursces and obligations are put in order.
Under chapter 11 reorganizations the courts must appoint a creditors committee. This committee usually consists of the seven largets unsecured creditors and is appointed as soon as practicable after the order for relief has enterd by the court. The task of the creditors committee is to examine the affairs of the business and decide whether the busisness shold continue in operation. The committee also usually determines whether to request of the court that a trustee should take over the managements of the business. If necessary, the comitte may employ attorneys accountans, and other agents to assits it in performing these task. Generally the debtor or any other interested party may file a plan file during the first 120 days after the petition has been filed (unless a trustee has been appointed) the debtor plan is usually developed in consultation with creditors. A debtor who file a plan approved by the creditors. The court can extend or reduce these time periods for good cause. If the debtor does not meet the deadline or is unable to obtain the consents of the creditor any party in interest (a creditors or the trustee) may propose a plan. The proposed must plan that must classify claims and ownership interests. It mst specify the treatment of each class of claims and must provide for the same treatment for all persons in the same class unless the holder of particular claim agrees to less favorable treatment. The plan must also provide adequate means for carrying out plans payment terms. If the debtor is a corporation, the plan must also protect stockholder voting rights, ensure that nonvoting stock will not be issued and provide that in the selection of officers and direction the interest of creditor and stockholders will be protected. The plan may modify the rights of some of the creditors. It may specify that some property be transferred to other creditors, that some creditors be partially paid over an extended time and even that some creditors not be paid. The only requirement is that all the debtors claimants must receive as much as they would have received in liquidation proceeding. Those who hold claims or interests in the debtor property are allowed to vote on the proposed plan. If creditor representing more than one half of the number of claimants and at least two third of the value of claims in a class vote in favor of the plan, that class of creditor has accepted the plan. Normally a plan will not be approved unless all those whose claims or interst have been impaired those whose rights have been altered or who are receive less than the full vale of their claims or interest have agree
