We are WIDOWS of retired SDOs of irrigation and power
department government of Sindh. In 1964 b a noti!cation "o 14#64
estt$1#6% dated &'.1.1964 the governor of erst whi(e province of west
)a*istan had granted ga+etted stat,s to irrigation department SDOs
-he noti!cation intera(ia state$
.the governor of west )a*istan is p(eased to order that over
seers#s,pervisors in the west )a*istan irrigation department whi(e
o/ciating as SDOs sha(( be treated as ga+etted o/cers and sha(( draw pa
in standard c(ass ii pa same via &012&12401 &0126112'01. -his pa sha((
be admissib(e to them on their forma( promotion form non ga+etted to
ga+etted stat,s in cons,(tation with West )a*istan p,b(ic service
commission3
On this ver date of noti!cation i.e. &'.1.1964 a(most a(( SDO were
o/ciating as non ga+etted o/cers. d,e to o/cia( apath, the case was
*ept in co(d storage and remained in process and after (apse of si4 and a
ha(f ears, 00sdos o,t of 1'0 SDOs were arbitrari( a((owed ga+etted
stat,s in c(ass ii pa sca(e with e5ect from &6.0.'1 and not from
&'.1.1964 the date if governor noti!cation. -his was a precedent to none.
It was *ind( be appreciated that the action ta*en a((owing 00sdos o,t 1'0
SDOs 7not in order of seniorit8 from &6.0.'1 and not from &'.1.64 the
date of governor noti!cation was i((ega( arbitrar irreverent and
inconsistent encroaching ,pon the rights of the senior SDOs of the
department. )ossibi(it of corr,ption e(ement cannot be r,(ed o,t a(ong
with vested interest of the department. -here was h,e and cr form
a5ectees b,t the were s,ppressed b saing that this is partia(
noti!cation as soon as the process is !na(ised, Revised noti!cation

again went in co(d storage for 6 ears and 11' SDOs were a((owed
ga+etted stat,s c(ass ii pa wide noti!cation no 1#%#0#'1 dated 16.4.19'6
after (apse of 1& ears 71964219'68 b,t this time the department showed
f,(( apath 7probab( these SDOs had not come in their net8 and
discriminate( a((owed them from 16.4.'6 not with e5ect from &6.0.19'1
as a((owed to pervio,s 6% SDOs mentioned in noti!cation dared 16.4.19'6
and a(( remaining SDOs inc(,ding 11' SDOs mentioned in noti!cation
dated 16.4.19'6 and a(( were a((owed with e5ect from &6.0.19'1 and not
from &'.1.1964 the governor noti!cation which was (egitimate right of
SDOs b,t instead this time it was mentioned in )ara & of this noti!cation
that no bac* bene!ts are a((owed as it was a((owed to 6 SDOs vide two
noti!cation dared &.'.19'1 and &6.'.19'1 mentioned above. -his was (i*e
the (ast straw on the came(;s bac*. 9(most man of the retired SDOs have
died awa and we widows are facing starvation with meagre pension
being drawn of the D<9D.
-he who(e case is discriminate( to that of SDOs of comm,nication and
wor*s department who were a((owed instant( with e5ect from 1&.1%.196%
as per simi(ar noti!cation of governor of West )a*istan.
It is a(so f,rther s,bmitted that in response to simi(ar noti!cation of
governor of <rnst whi(e west )a*istan, e42),n=ab irrigation SDOs were
a((owed from the date of o/ciating as sod of each one as contained in the
noti!cation of the governor and the got a(( the bac* bene!ts vide
noti!cation no.1'#'4%2% 1117<8 66 dated 11

In a simi(ar case vide a Sindh government noti!cation "O.S? 792118
07668#'&211 dated 6.6.19'0. research assistant in agric,(t,re department
government of Sindh were ,pgraded to grade 16 and vide government
ga+ette dated ma 16,19'6 these research assistant #agric,(t,re assistant
was p(aced in grade 16 with e5ect from the bac* date of their
appointment via &6.6.19'&. In this connection a simi(ar Sindh government
noti!cation "O. <st. 17,p grad,ation 99S8 conse@,ent ,pon ,p gradation
the post of agric,(t,re assistant were a((owed to ass,me the charge in
grade 16 from the date of their appointment via &6.6.19'& from the date
the are wor*ing. Whi(e the irrigation department a(tho,gh the SDOs were
o/ciating as SDOs on &'.1.1964, the date of governor;s noti!cation, were
denied their (egitimate right from the date of o/ciating on the post and is
discriminator to that of agric,(t,re and (ivestoc* viner s,rgeons of
Sindh.

a((owed from the date of their appointment via &6.6.19'&. -hese are the
cases simi(ar to irrigation department SDOs b,t irrigation department
deprived them of their (eg mite rights not a((owed from &'.1.1964 on
which date the were o/ciating on the post. -here are man co,rt
decisions a(so to a((ow ,p grading from the d,e date with conse@,entia(
bene!ts.
Areat in=,stice done with irrigation retired SDOs need immediate attention
of a(( concerned p(ease and their (egitimate d,es pending since fo,r
decades bac* are c(eared to meet the end of =,stice. <ver since then, the
!(es have not seen the (ight of the da and revised noti!cation is pending
with the department a((owing with e5ect from &'.1.1964 as per governor;s
noti!cation. It is a(so re@,ested that those who p(aed fo,( m,st be ta*en
to tas*. 9rtic(e &0 of the constit,tion bar discrimination. <mp(oees co,(d
not be discriminated against and their f,ndamenta( rights are to be ,p
