BUREAU OF FIRE PROTECTION (BFP) AND THE BUREAU OF AIL MANAGEMENT AND PENOLOGY

Pursuant to Section 3 of Republic Act No. 9592 which took efect on May 2! 2""9! the #epart$ent
of the %nterior an& 'ocal (o)ern$ent! in coor&ination with the *ureau of +ire Protection! the *ureau of ,ail
Mana-e$ent an& Penolo-y! the .i)il Ser)ice .o$$ission an& the .o$$ission on /i-her 0&ucation
1./0#2! hereby a&opts an& pro$ul-ates the followin- i$ple$entin- rules an& re-ulations3
RULE I
QUALIFICATIONS FOR INITIAL APPOINTMENT TO THE BFP AND THE BMP
AND AMENDMENTS TO THE EDUCATION AND ELIGIBILITY REQUIREMENTS
FOR INCUMBENT UNIFORMED PERSONNEL
SECTION ). GENERAL QUALIFICATIONS FOR APPOINTMENT

A. %nitial Appoint$ent 4 No person shall be appointe& as unifor$e& personnel of the *+P an& the
*,MP unless he5she possesses the followin- $ini$u$ 6uali7cations3

3. Must ha)e passe& the psychiatric5psycholo-ical! &ru- an& physical tests for the purpose
of &eter$inin- his5her physical an& $ental health:

5. Must possess the appropriate ci)il ser)ice eli-ibility:
<. Must not ha)e been &ishonorably &ischar-e& or &is$isse& for cause fro$ pre)ious
e$ploy$ent:
. Must not ha)e been con)icte& by 7nal =u&-$ent of an ofense or cri$e in)ol)in- $oral
turpitu&e:
>. Must not be less than twenty?one 1282 nor $ore than thirty 13"2 years of a-e:

one $eter an& 7fty?se)en centi$eters 18.5 $.2 for fe$ale: Provided! that a wai)er for
hei-ht an& a-e re6uire$ents shall be auto$atically -rante& to applicants belon-in- to
the cultural co$$unities: an&

correspon&in- to his5her hei-ht! a-e an& se@.
Ahe abo)e?enu$erate& 6uali7cations shall be continuin- in character! e@cept for para-raph
>! an& an absence of any one of the$ at any -i)en ti$e shall be a -roun& for separation or
retire$ent fro$ the ser)ice.
*. %ncu$bent Bnifor$e& Personnel All incu$bent unifor$e& personnel of the *+P an& the *,MP
shall continuously possess the 6uali7cations un&er Section 8 para-raph A of this %RR! sub=ect to the
followin-3
8. Bnifor$e& personnel who are alrea&y in the ser)ice prior to the efecti)ity of Republic Act
No. 92<3 shall be -i)en another 7)e 152 years to obtain the $ini$u$ e&ucational
6uali7cation an& appropriate ci)il ser)ice eli-ibility to be reckone& fro$ May 2! 2""9!
the &ate of the efecti)ity of Republic Act No. 9592:

2. %ncu$bent unifor$e& personnel who ha)e ac6uire& NAPC'.CM eli-ibility prior to the
efecti)ity of Republic Act No. 92<3 shall be consi&ere& to ha)e co$plie& with the
appropriate ci)il ser)ice eli-ibility:
3. *+P an& *,MP unifor$e& personnel who &o not $eet the $ini$u$ e&ucational
6uali7cation an& eli-ibility re6uire$ent! but ha)e ren&ere& $ore than 7fteen 1852 years
of ser)ice at the ti$e of the efecti)ity of Republic Act No. 9592 shall no lon-er be
re6uire& to co$ply with the afore$entione& e&ucational an& eli-ibility re6uire$ents.
/owe)er! they shall not be 6uali7e& for pro$otion to the ne@t hi-her rank )ia re-ular
pro$otion unless they ha)e co$plie& with the e&ucational an& eli-ibility re6uire$ents.
Ne)ertheless! they shall be e@e$pte& fro$ Section 8;! Rule D%% an& Section 8;! Rule ED%
of the %RR of RA 92<3 or the attrition pro)ision of the law if not pro$ote& within a perio&
of ten 18"2 consecuti)e years:
;. Si$ilarly! incu$bent *+P an& *,MP unifor$e& personnel with 7rst le)el ci)il ser)ice
eli-ibility prior to Republic Act No. 92<3! shall be appointe& in per$anent status!
pro)i&e& they $et the other re6uire$ents of the rank:
5. After the lapse of the 7)e?year re-le$entary perio& -i)en to those who ha)e ser)e& the
*+P or the *,MP for 7fteen 1852 years or less upon the efecti)ity of Republic Act No.
9592, current *+P an& *,MP unifor$e& personnel who still fail to satisfy any of the
afore$entione& re6uire$ents shall be separate& fro$ the ser)ice if they are below 7fty
15"2 years of a-e an& ha)e ser)e& in the -o)ern$ent for less than twenty 12"2 years! or
retire& if they are fro$ a-e 7fty 15"2 an& abo)e an& ha)e ser)e& in the -o)ern$ent for
at least twenty 12"2 years without pre=u&ice in either case to the pay$ent of bene7ts
they $ay be entitle& to un&er e@istin- laws: Provided, that personnel who ha)e ser)e&
the -o)ern$ent for at least twenty 12"2 years but whose a-e is less than 7fty 15"2 $ay
a)ail of optional retire$ent.
SECTION 2. WAIVER FOR INITIAL APPOINTMENT TO THE BFP AND THE BMP
A. Fai)er for hei-ht an& a-e! re6uire$ent shall be auto$atically -rante& by the .hief! *+P an& the
.hief! *,MP to applicants belon-in- to the cultural co$$unities: Provided! that applicants who
belon- to cultural co$$unities $ust sub$it proof of their $e$bership in a particular cultural
$inority as certi7e& by the National .o$$ission on %n&i-enous People 1N.%P2 or the CGce of
Musli$ Afairs 1CMA2.
*. %n all other cases! as $ay be &eter$ine& an& upon reco$$en&ation of the *+P Personnel
Selection *oar& in the Re-ions or the National /ea&6uarters! wai)er of a-e an& hei-ht re6uire$ent
$ay be -rante& by the .hief! *+P to applicants who possess any of the followin-3
8. Cutstan&in- scholastic acco$plish$ents! such as bein- honor -ra&uates! consistent
aca&e$ic scholars! boar&5bar topnotchers an& the like:
2. Possession of special skills in 7re suppression! 7re pre)ention! knowle&-e an& skill in
operation of hea)y e6uip$ent! such as aerial la&&er! s6uirt! li-htin- tower truck! rescue
ten&er an& other apparatus an& e6uip$ent! rescue an& e$er-ency $e&ical ser)ices:
3. /ol&er of professional &ri)erHs license with 2 an& " restriction co&e:
;. Mechanic with A0S#A $echanic tra&e test certi7cate with e@pertise in pu$p operation!
auto &iesel en-ine an& auto electrical troubleshootin-: or
5. Cther skills that will sustain the tra&itions5other &e$an&s of the unifor$e& ser)ice.
Fai)er for a-e an& hei-ht re6uire$ents $ay only be -rante& by the .hief! *,MP upon the
reco$$en&ation of the National or the Re-ional Recruit$ent an& Selection *oar& 1NRS*5RRS*2.
Ahe recipient of a wai)er in the *,MP shall possess any re&ee$in- 6uali7cation! professional
co$petence or skill like3

8. Cutstan&in- scholastic acco$plish$ents! such as bein- honor -ra&uates! consistent
aca&e$ic scholars! boar&5bar topnotchers an& the like:
2. Possessin- a technical skill nee&e& by the *,MP as $ay be i&enti7e& by the NRS*5RRS*:
3. Possessin- e@perience of )alue to the *,MP as $ay be i&enti7e& by the NRS*5RRS*: or
;. Possessin- an e&ucational 6uali7cation hi-her than or in a&&ition to! the re6uisite
e&ucational or aca&e$ic re6uire$ent.
Provided, that wai)er un&er Section 2 para-raph * hereof $ay be -rante& only when the nu$ber of
6uali7e& applicants falls below the $ini$u$ 6uota! e@cept in cases where an applicant with wai)er
possesses superior 6uali7cations.

e@cee& forty 1;"2 years: Provided! 7nally! that his5her pre)ious separation fro$ the -o)ern$ent
ser)ice was not for cause:

$ale applicant who is at least 8 $eter an& 5 centi$eters 18.5$2 an& to a fe$ale applicant who is
at least 8 $eter an& 52 centi$eters 18.52$2: an&
0. Ahe hei-ht an& a-e re6uire$ents shall only be wai)e& sub=ect to the con&ition that the
applicant $eets an& possesses all other 6uali7cation stan&ar&s.
RULE II
AMENDMENTS TO PROMOTION REQUIREMENTS
OF BFP AND BMP UNIFORMED PERSONNEL
SECTION ". RATIONALI%ED PROMOTION SYSTEM * Ahe #%'( throu-h the reco$$en&ation of the *+P
an& the *,MP shall establish a syste$ of pro$otion for unifor$e& personnel of the *+P an& the *,MP which
shall be base& on $erit an& 7tness in consonance with the .i)il Ser)ice 'aw an& Rules an& on the
a)ailability of )acant ranks in the *+P an& the *,MP staGn- pattern. Such syste$ shall be -en&er?fair an&
shall ensure that all $e$bers of the +ire *ureau an& the ,ail *ureau shall en=oy e6ual opportunity for
pro$otion.
SECTION '. MODES OF PROMOTION * Ahe two 122 $o&es of pro$otion in the *+P an& the *,MP are as
follows3
A. Re-ular Pro$otion 4 Any unifor$e& personnel of the *+P an& the *,MP who has $et the
$ini$u$ 6uali7cations for a rank which shall inclu&e e&ucation! e@perience! trainin-! an&
appropriate ci)il ser)ice eli-ibility! an& has satisfactorily passe& the re6uire&
psychiatric5psycholo-ical! &ru- an& physical tests shall be eli-ible for pro$otion to the ne@t hi-her
rank. +or purposes of the eli-ibility re6uire$ent! *+P an& *,MP personnel who ha)e obtaine&
NAPC'.CM eli-ibility prior to the efecti)ity of Republic Act No. 92<3! hereun&er classi7e&! shall be
consi&ere& to ha)e co$plie& with the appropriate ci)il ser)ice eli-ibility re6uire$ent.

1. Meritorious Pro$otion ? Any unifor$e& personnel of the *+P an& the *,MP who has
e@hibite& acts of conspicuous coura-e an& -allantry at the risk of his5her life abo)e an&
beyon& the call of &uty shall be pro$ote& to the ne@t hi-her rank:
2. Special Pro$otion base& on awar&s ? *+P an& *,MP personnel selecte& for an awar& in a
nationwi&e search con&ucte& by any accre&ite& ci)ic or-ani9ation shall be pro$ote& to
the ne@t hi-her rank:
3. Cn?the?spot pro$otion ? a special pro$otion -rante& instantaneously at or near the
scene of an inci&ent or occurrence or at any place i$$e&iately thereafter to any *+P or
*,MP unifor$e& personnel who has e@hibite& acts of conspicuous coura-e an& -allantry
at the risk of his or her life abo)e an& beyon& the call of &uty conferre& by an appointin-
authority such as Re-ional #irector of the *+P an& the *,MP or .hief! *+P an& .hief! *,MP
as the case $ay be! #%'( Bn&ersecretary for Public Safety! #%'( Secretary or the
Presi&ent of the Republic of the Philippines accor&in- to his5her soun& =u&-$ent or
&iscretion which re6uire no further e)aluation by the Pro$otions *oar&:
;. Posthu$ous Pro$otion 4any *+P or *,MP unifor$e& personnel who &ie in line of &uty but
eli-ible for optional retire$ent shoul& be -i)en rank pro$otion.
All $o&es of special pro$otion shall be )ali&ate& by the #%'( an& the .S. base& on
respecti)e *+P an& *,MP establishe& criteria as $an&ate& by e@istin- law.
.onsi&erin- the peculiar nature of special pro$otion! 6uali7cation stan&ar&s 1KS2 for )arious
ranks as appro)e& by the .S. shall not apply. %n lieu thereof! speci7c -ui&elines for special
pro$otion shall be prepare& by the *+P an& the *,MP in close coor&ination with the #%'( an& the
.S.. Ahe -ui&elines $ay be a$en&e& to confor$ to the e@istin- con&itions an&5or when such
a$en&$ent will ser)e -reater public interest.

RULE III
FINAL PROVISIONS
SECTION 5. SEPARABILITY CLAUSE 4 %f for any reason! any pro)ision hereof is &eclare& to be
unconstitutional or in)ali&! the other sections or pro)ision hereof which are not afecte& thereby shall
continue to be in full force an& efect.
SECTION !. REPEALING CLAUSE 4 All laws! &ecrees! $e$oran&u$ circulars! resolutions! or&ers an&
other issuances or parts thereof which are inconsistent with Republic Act No. 9592 an& with these
%$ple$entin- Rules an& Re-ulations are hereby repeale&! a$en&e& or $o&i7e& accor&in-ly.
SECTION +. IMPLEMENTING DETAILS * Ahe #epart$ent of the %nterior an& 'ocal (o)ern$ent after
consultation with the *+P an& the *,MP in coor&ination with the .i)il Ser)ice .o$$ission an& .o$$ission
on /i-her 0&ucation $ay a$en& this %$ple$entin- Rules an& Re-ulations or issue such a&&itional rules
an& re-ulations as $ay be necessary to carry into efect the intention of the law or further clarify any part
thereof.
SECTION ,. EFFECTIVITY 4 Ahese %$ple$entin- Rules an& Re-ulations shall take efect upon its
publication in two 122 newspapers of -eneral circulation.
