ESY IS INTENDED FOR PUPILS WHO DEMONSTRATE A NEED FOR CONTINUED SERVICE BEYOND THE INSTRUCTIONAL YEAR AS A NECESSARY COMPONENT OF FAPE. ESY MUST BE PROVIDED WHEN:
Regression requires more than the length of the break to recoup. Will there be significant decline in performance over summer? Will it take longer than the length of the break (e.g. 12 weeks of summer) to return to the pupils June level of performance?

Services are necessary to attain/maintain self-sufficiency, OR Services are otherwise necessary to ensure FAPE

DETERMINATION
Determination of ESY eligibility is part of the IEP process and should be done annually at the IEP meeting or at the time of an IEP review. The documentation of severe regression is an integral part and may not be ignored simply because a parent or guardian wants their child to attend. Referrals will not be accepted if not part of the IEP process.

THE IEP TEAM DETERMINES THAT PUPIL QUALIFIES FOR ESY THEN THE CASE MANAGER WILL SUBMIT TO LIZ RIEPE.

o Extended School Year Eligibility Form o Intent to send the student to ESY, signed by parent;

o Documentation of regression; and

o Copy of the IEP, including PBIP

PARENT CONSENT
The IEP case manager will confirm with the parent that the student will be attending ESY by having the intent letter signed. This must be done prior to submitting any referral to ESY reducing the number of parents who report that they did not know that their child was referred for ESY.

OTHER IMPORTANT POINTS

Referrals made later than April 1st, 2013 will be considered only in extreme circumstances.

ESY eligibility forms will be reviewed to insure compliance with all special education law. The IEP case manager will be contacted if more information is needed.
MRVSEC/CSEC will send scheduling information to parents. Be sure that you have completed all the required documents, NO incomplete applications will be accepted.
