A November 14, 2006, letter from FHWA to Mr. D.J. Mcinnes, corrected FHWA’s July 18, 2005, letter, which stated it would be acceptable to withdraw the project and refund the obligated Federal funds. In accordance with 23 USC 156, States must charge, at a minimum, the current fair market value for the sale of real property acquired with Federal assistance under Title 23 and the Federal share of the proceeds credited back to the subject project. The December 2004 appraisal, which the city of Northport refers to in its January 18, 2007, letter to Ms. Dee Rowe is over two years old and is not acceptable for submittal. Therefore, we request that the property be reappraised actording to the State's appraisal regulations and be submitted to the Right-of-Way Bureau for processing. The disposal process should be the same as for disposing of excess right-of-way for proprietary purposes.
