A November 14, 2006, letter from FHWA to Mr. D.J. Mcinnes, corrected FHWA’s July 18, 2005, letter, which stated it would be acceptable to withdraw the project and refund the obligated Federal funds. In accordance with 23 USC 156, States must charge, at a minimum, the current fair market value for the sale of real property acquired with Federal assistance under Title 23 and the Federal share of the proceeds credited back to the subject project. The December 2004 appraisal, which the city of Northport refers to in its January 18, 2007, letter to Ms. Dee Rowe is over two years old and is not acceptable for submittal. Therefore, we request that the property be reappraised actording to the State's appraisal regulations and be submitted to the Right-of-Way Bureau for processing. The disposal process should be the same as for disposing of excess right-of-way for proprietary purposes. Please advise the city of Northport to follow the State’s disposal of excess property regulations and to cconsuit with the Muitimodai Buceau regarding tracking the Federal funds during this project, Sincerely yours, Is/Mark D. This is only a small portion ofthat acquired under the Enhancement Grant. We have discussed this request with the Federal Highway Administration through the ALDOT Modal Bureau and have received the attached ‘correspondence from the Federal Highway Administration dated February 14, 2007. The following issues and guidelines must be addressed and followed to proceed: 4) Acurrent appraisal is required as per 23 CFR 710.5114(c) ‘a, Must be less than one year old b. Appraiser must be approved by the Alabama Department of Transportation ¢, Appraisal must be submitted on State forms. 4. Appraisal must meet State Specifications. . The cost of the appraisal is not eligible for reimbursement and should be paid by the Ci 2) Suney: ‘a, Signed and Sealed survey of property. b. The cost of the survey isnot eligible for reimbursement and should be paid by the City 3) Concurrences: ‘a. ‘Alabama Historical Commission concurrence and acceptance of historical context study of gin sites must be sent to this office for review. b. Alabama Department of Environmental Management (ADEM) Unconditional Letter of Concurrence for the former Bames & Norris Gin Property. (Corespondence dated December 6, 2006.) must be sent to this office for review. eS. Corps of Engineers concurrence with property sale must be sent to this office for review. Disposal of excess property, required as per 23 CFR 710.401 ‘a. The City may use their Property Management Procedures Manual provided it was approved by the State. This should be the final document needed to complete our requirements for transfer of the Gin Property to the City of Northport. \ding that the Appraisal was forward to Montgomery the week of the 23" of April. It is our hope that with the submission of the Context Study we might hear something from the Highway Department by the end of this week, and ‘would be able to begin the process of transferring the property sometime next week. As you know we have a May 31” deadline (closing date) to complete this transaction, therefore timing is critical at this point. I want to thank you both for all your help moving this process along. Please let me know if there is anything else we need to do.
