A RESOLUTIONBY THE CITY COUNCIL OF
P elican Ra y TTEXAS,
APPROVING PARTICIPATION IN TELEPHONE
FRANCHISE STEERING COMMITTEE; AND
DECI-ARING AN EFFECTTVE DATE

WHEREAS, the City has a public responsibilityto protect the public rights-of-way
and easementsand to require the telephonecompanyto assumecertain duties and
responsibilitiesregardingsuch easemeirtsand rigfits-rif-wayby means of reasonable
terms and conditionsin a franchiseordinance;and

WHEREAS, a steering committee of cities could share information, develop a

model ordinance, obtain special legal and auditing counsel and provide further
assistanceto the member cities in the adoption of franchise ordinanceswith the
telephoneutility company;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
P e1ic an Bav , Texas:
Section1. That the participation by the City in the Telephone Franchise
SteeringCommitteeis herebyapprovedand doesnot obligatethe City
to anypayment.

Section2. It is anticipatedthat a pro-ratafee shallbe assessed

by the Telephone
Franchise Steering Committee at a later date. Such financial
obligationshall require the approvalof a separateresolution. Such
fee shall be basedupon expectedcostsfor the purposesstated above
and be determinedby the populationof the City.
Section3. That this resolutionshallbe effectivewhen adopted.
