HAITI-OBSERVATEUR GROUP, an unknown business entity, and LEO JOSEPH, an individual Defendants. / ORDER TO SHOW CAUSE THIS CAUSE is before the Court upon a sua sponte examination of the record. THE COURT has considered the pertinent portions of the record, and is otherwise fully advised in the premises. On January 15, 2013, Plaintiffs moved for the entry of a Clerks Default against Defendant Leo Joseph (Joseph). D.E. 22. On January 16, 2013, the Clerk of the Court entered a Default against Mr. Joseph. D.E. 23. On this same day, the Court directed Plaintiffs to file a Motion for Default Judgment against Mr. Joseph no later than January 24, 2013. Plaintiffs have failed to do so. Additionally, it appears from the record that Plaintiffs have failed to serve Defendant HaitiObservateur Group (HOG), referred to by Plaintiffs Amended Complaint as an unknown business entity and the alter ego of Mr. Joseph, D.E. 4, despite commencing the instant action more than 120 days ago. See D.E. 1. Accordingly, it is hereby ORDERED AND ADJUDGED that Plaintiffs shall show good cause, in writing, as to the following: (1) why Plaintiffs have failed to move for Default Judgment against Mr. Joseph in wanton disregard of the Courts clear instruction in D.E. 22 and (2) why Plaintiffs have failed to

serve Defendant HOG. Plaintiffs shall file a response to this Order no later than 5 p.m. on January 30, 2013. Failure to comply with this order will result in the dismissal of the present action without further notice. DONE AND ORDERED in Chambers, Miami, Florida, this 28th day of January, 2013.
