Chapter 1. Introduction
is the office of the president of the united states (POTUS) beyond reproach?
As an undergraduate college student in the mid-1970s our nation (and myself) were transfixed by watching the Senate Watergate hearings co-chaired by Samuel Ervin (Democrat – North Carolina) and Howard Baker (Republican – Tennessee) on television. Subsequently, a broken nation watched as President Richard M. Nixon gave a final salute as he departed the White House after his resignation aboard Marine One. And finally, I had the solemn opportunity to attend two sessions of the Watergate trials of several Nixon aides in-person led by John Joseph Sirica who was the Chief Judge for the United States District Court for the District of Columbia.
Impeachment is indeed a grave matter for the US which needs to be addressed in a nonpartisan manner with the highest degree of integrity - above reproach - in order to maintain the unity of the nation.
This book will seek to approach this topic in a fair and unbiased way. It will examine the US Constitution with regard to impeachment, historical precedents, the key players in a possible impeachment process, the role of Congress as well as a Special Counsel and the rights (and legal powers) of the President during the process.
And while it would appear that our government is at the very early stages of this process and only God knows the outcome of the three major investigations currently underway, this book will attempt to highlight any similarities and differences between President Trump and the finite number of his predecessors which have faced impeachment.
Finally, the goal herein is not to rush to judgment, rather to illuminate the cold hard facts, however illusive, that might lead to impeachment of only the fourth sitting President of the United States (POTUS).
As our founding fathers foresaw the possibility
that a US President may need to be removed from office, with great wisdom and foresight they incorporated impeachment into our nation’s constitution almost two and a half centuries ago.
Chapter 2. the US Constitution - Article II
putting our founding fathers to the test
The framers of the US Constitution
Except Rhode Island, the original states collectively appointed 70 individuals to the Constitutional Convention. Fifty-five delegates actually attended the Constitutional Convention sessions, however only 39 signed the US Constitution which is preserved for posterity in the National Archives. The delegates ranged in age from Benjamin Franklin, aged 81, who was so infirm that he had to be carried to sessions in a sedan chair to Jonathan Dayton, aged 26.
Signed in convention September 17, 1787 and confirmed in June 1788. Portions of Article II, Section 1 of the US Constitution, were modified by the 12th and the 25th Amendments to the US Constitution. Executive Power would be held by a President of the United States of America who will hold Office during a 4 year term
